## Hadith #4446

some Bedouin people used to bring us meat, and we did not know whether they had mentioned the Name of Allah (when slaughtering it) or not. The Messenger of Allah said: “Messenger of Allah said: “Mention the Name of Allah and eat.” (Sahih )

## Hadith #4689

the Messenger of Allah ruled that if a man found (his goods) in the possession of a man who was not guilty, then if he wished he could give the man what he had paid for it, or if he wished he could go after the one who had stolen it. Abu Bakr and ‘Umar passed similar judgments.

there was the governor of Al-Yamamah, and Marwan wrote to him saying that Mu’awiyah had written to him, saying that any man who had something stolen from him had more right to it wherever he found it. Then Marwan wrote saying that to me (Usaid). I wrote to Marwan saying that the Prophet had ruled that if the one who bought it from the one who stole it is ot guilty of anything (and did not realize that it was stolen goods), then the owner has the choice: If he wishes, he may buy it from the one who bought it from the thief, or if he wishes he may go after the thief. Abu Bakr, ‘Umar and ‘Uthman also passed judgment along these lines. Marwan sent my letter to Mu’awiyah, and Mu’awiyah wrote to Marwan (saying): ‘Neither you nor Usaid are in a position to tell me what to do, rather I am the one who tells you what to do because I am superior in rank to you, so do what I tell you.’ Marwan sent the letter of Mu’awiyah to me, and I said: I will not judge according to Mu’awiyah’s opinion as long as I am the governor.”‘

The Holy Prophet (ﷺ) gave a decision between two men, and the one against whom the decision was given turned away and said: For me Allah sufficeth, and He is the best dispenser of affairs. The Holy Prophet (ﷺ) said: Allah, Most High, blames for falling short, but apply intelligence, and when the matter gets the better of you, say; For me Allah sufficeth, and He is the best disposer of affairs.

“I said to Abu Ayyub: ‘Do you know of anyone who said that: “Your case is up to you?” counts as three besides Al-Hasan?’ He said: “No, not besides Al-Hasan.’ Then he said: ‘O Allah forgive me – except for what has been narrated to me by Qatadah, from Kathir the freed slave of Banu Samurah, from Abu Salamah, from Abu Hurairah, that the Prophet said: “Three.'”Abu Ayyub said: ‘So I met Kathir the freed slave of Banu Samurah and asked him about it, but he was not aware of it. So I returned to Qatadah and informed him about that and he said: “He forgot.”

“I heard the Prophet (ﷺ) say: ‘There is no band of warriors that fights in the cause of Allah and acquires war spoils, but they have been given two thirds of their reward, but if they do not get any spoils of war, then they will have their reward in full (in the Hereafter).’”

It was narrated from Ibn ‘Umar that the Prophet (ﷺ) distributed the war spoils on the Day of Khaibar, giving three shares to the horseman, two shares for the horse, and one share for the man.

“I fought alongside my master on the Day of Khaibar, and I was a slave. I was not given anything from the spoils of war but I was given from the least of the utensils (goods) a sword, which I dragged when I put it around my waist.”

“Whenever he appointed a man to lead a military detachment, the Messenger of Allah (ﷺ) would advise him especially to fear Allah and treat the Muslims with him well. He (ﷺ) said: ‘Fight in the Name of Allah and in the cause of Allah. Fight those how disbelieve in Allah. Fight but do not be treacherous, do not steal from the spoils of war, do not mutilate and do not kill children. When you meet your enemy from among the polytheists, call them to one of three things. Whichever of them they respond to, accept it from them and refrain from fighting them. Invite them to accept Islam, and if they respond then accept it from them and refrain from fighting them. Then invite them to leave their land and move to the land of the polytheists. Tell them that if they do that, then they will have the same rights and duties as the polytheists. If they refuse, then tell them that they will be like the Muslim Bedouins (who live in the desert), subject to the same rulings of Allah as the believers. But they will have no share of Fay’* or war spoils, unless they fight alongside the Muslims. If they refuse to enter Islam, then ask them to pay the Poll-tax. If they do that, then accept it from them and refrain from fighting them. But if they refuse, then seek the help of Allah against them and fight them. If you lay siege to them and they want you to give them the protection of Allah and your Prophet, do not give them the protection of Allah and your Prophet, rather give them your protection and the protection of your father and your Companions, for if you violate your protection and the protection of your fathers, that is easier than violating the protection of Allah and the protection of His Messenger. If you lay siege to them and they want you to let them come out with a promise of the judgement of Allah and His Messenger (ﷺ), do not offer them a promise of the judgement of Allah and His Messenger (ﷺ), rather offer them your judgement, because you do not know if you will actually pass (the same as) Allah’s judgement regarding them or not.’”
