Eating, Drinking and Sexual Intercourse are allowed during the Nights of Ramadan
These Ayat contain a relief from Allah for the Muslims by ending the practice that was observed in the early years of Islam. At that time, Muslims were allowed to eat, drink and have sexual intercourse only until the `Isha' (Night) prayer, unless one sleeps before the `Isha' prayer. Those who slept before `Isha' or offered the `Isha' prayer, were not allowed to drink, eat or sexual intervourse sex until the next night. The Muslims found that to be difficult for them.
The Ayat used the word `Rafath' to indicate sexual intercourse, according to Ibn `Abbas, `Ata' and Mujahid. Similar Tafsir was offered by Sa`id bin Jubayr, Tawus, Salim bin `Abdullah, `Amr bin Dinar, Al-Hasan, Qatadah, Az-Zuhri, Ad-Dahhak, Ibrahim An-Nakha`i, As-Suddi, `Ata' Al-Khurasani and Muqatil bin Hayyan.
Allah said:
هُنَّ لِبَاسٌ لَّكُمْ وَأَنتُمْ لِبَاسٌ لَّهُنَّ
(They are Libas i.e., body-cover, or screen for you and you are Libas for them.)
Ibn `Abbas, Mujahid, Sa`id bin Jubayr, Al-Hasan, Qatadah, As-Suddi and Muqatil bin Hayyan said that this Ayah means, "Your wives are a resort for you and you for them." Ar-Rabi` bin Anas said, "They are your cover and you are their cover." In short, the wife and the husband are intimate and have sexual intercourse with each other, and this is why they were permitted to have sexual activity during the nights of Ramadan, so that matters are made easier for them.
Abu Ishaq reported that Al-Bara' bin `Azib said, "When the Companions of Allah's Messenger ﷺ observed fast but would sleep before breaking their fast, they would continue fasting until the following night. Qays bin Sirmah Al-Ansari was fasting one day and was working in his land. When the time to break the fast came, he went to his wife and said, `Do you have food' She said, `No. But I could try to get you some.' His eyes then were overcome by sleep and when his wife came back, she found him asleep. She said, `Woe unto you! Did you sleep' In the middle of the next day, he lost consciousness and mentioned what had happened to the Prophet . Then, this Ayah was revealed: r
أُحِلَّ لَكُمْ لَيْلَةَ الصِّيَامِ الرَّفَثُ إِلَى نِسَآئِكُمْ
(It is made lawful for you to have sexual relations with your wives on the night of As-Siyam (fasting)) until...
وَكُلُواْ وَاشْرَبُواْ حَتَّى يَتَبَيَّنَ لَكُمُ الْخَيْطُ الأَبْيَضُ مِنَ الْخَيْطِ الأَسْوَدِ مِنَ الْفَجْرِ
(and eat and drink until the white thread (light) of dawn appears to you distinct from the black thread (darkness of night), then complete your fast till the nightfall. ) Consequently, they were very delighted." Al-Bukhari reported this Hadith by Abu Ishaq who related that he heard Al-Bara' say, "When fasting Ramadan was ordained, Muslims used to refrain from sleeping with their wives the entire month, but some men used to deceive themselves. Allah revealed:
عَلِمَ اللَّهُ أَنَّكُمْ كُنتُمْ تَخْتانُونَ أَنفُسَكُمْ فَتَابَ عَلَيْكُمْ وَعَفَا عَنكُمْ
(Allah knows that you used to deceive yourselves, so He turned to you (accepted your repentance) and forgave you.)
`Ali bin Abu Talhah narrated that Ibn `Abbas said, "During the month of Ramadan, after Muslims would pray `Isha', they would not touch their women and food until the next night. Then some Muslims, including `Umar bin Al-Khattab, touched (had sex with) their wives and had some food during Ramadan after `Isha'. They complained to Allah's Messenger ﷺ . Then Allah sent down:
عَلِمَ اللَّهُ أَنَّكُمْ كُنتُمْ تَخْتانُونَ أَنفُسَكُمْ فَتَابَ عَلَيْكُمْ وَعَفَا عَنكُمْ فَالـنَ بَـشِرُوهُنَّ
(Allah knows that you used to deceive yourselves, so He turned to you (accepted your repentance) and forgave you. So now have sexual relations with them)" This is the same narration that Al-`Awfi related from Ibn `Abbas.
Allah said:
وَابْتَغُواْ مَا كَتَبَ اللَّهُ لَكُمْ
(. ..and seek that which Allah has ordained for you (offspring),)
Abu Hurayrah, Ibn `Abbas, Anas, Shurayh Al-Qadi, Mujahid, `Ikrimah, Sa`id bin Jubayr, `Ata', Ar-Rabi` bin Anas, As-Suddi, Zayd bin Aslam, Hakam bin `Utbah, Muqatil bin Hayyan, Al-Hasan Al-Basri, Ad-Dahhak, Qatadah, and others said that this Ayah refers to having offspring. Qatadah said that the Ayah means, "Seek the permission that Allah has allowed for you." Sa`id narrated that Qatadah said,
وَابْتَغُواْ مَا كَتَبَ اللَّهُ لَكُمْ
(and seek that which Allah has ordained for you,)
Time for Suhur
Allah said:
وَكُلُواْ وَاشْرَبُواْ حَتَّى يَتَبَيَّنَ لَكُمُ الْخَيْطُ الأَبْيَضُ مِنَ الْخَيْطِ الأَسْوَدِ مِنَ الْفَجْرِ ثُمَّ أَتِمُّواْ الصِّيَامَ إِلَى الَّيْلِ
(...and eat and drink until the white thread (light) of dawn appears to you distinct from the black thread (darkness of night), then complete your fast till the nightfall.)
Allah has allowed eating and drinking, along with having sexual intercourse, as we have stated, during any part of the night until the light of dawn is distinguished from the darkness of the night. Allah has described that time as `distinguishing the white thread from the black thread.' He then made it clearer when He said:
مِنَ الْفَجْرِ
(of dawn.)
As stated in a Hadith that Imam Abu `Abdullah Al-Bukhari recorded, Sahl bin Sa`d said, "When the following verse was revealed:
وَكُلُواْ وَاشْرَبُواْ حَتَّى يَتَبَيَّنَ لَكُمُ الْخَيْطُ الأَبْيَضُ مِنَ الْخَيْطِ الأَسْوَدِ
(Eat and drink until the white thread appears to you, distinct from the black thread) and (of dawn) was not revealed, some people who intended to fast, tied black and white threads to their legs and went on eating till they differentiated between the two. Allah then revealed the words, (of dawn), and it became clear to them that it meant (the darkness of) night and (the light of) day. "
Al-Bukhari recorded that Ash-Sha`bi said that `Adi said, "I took two strings, one black and the other white and kept them under my pillow and went on looking at them throughout the night, but could not make any distinction between the two. So, the next morning I went to Allah's Messenger ﷺ and told him the whole story. He said:
«إِنَّ وِسَادَكَ إِذًا لَعَرِيضٌ، أَنْ كَانَ الْخَيْطُ الْأَبْيَضُ وَالْأَسْوَدُ تَحْتَ وِسَادَتِك»
(Your pillow is very wide if the white and black threads are under it!) Some wordings for this Hadith read,
«إِنَّكَ لَعَرِيضُ الْقَفَا»
(Your Qafa (back side of your neck) is wide!)
Some people said that these words meant that `Adi was not smart. This is a weak opinion. The narration that Al-Bukhari collected explains this part of the Hadith. Al-Bukhari recorded that `Adi bin Hatim narrated: I said, "O Messenger of Allah ﷺ! What is the white thread from the black thread Are they actual threads" He said:
«إنَّكَ لَعَرِيضُ الْقَفَا أَنْ أَبْصَرْتَ الْخَيْطَيْنِ، ثُمَّ قَالَ: لَا بَلْ هُوَ سَوَادُ اللَّيْلِ وَبَيَاضُ النَّهَار»
(Your Qafa is wide if you see the two threads. Rather, they are the blackness of the night and the whiteness of the daylight.)
Suhur is recommended
Allah allowed eating and drinking until dawn, it represents proof that Suhur is encouraged, since it is a Rukhsah (concession or allowance) and Allah likes that the Rukhsah is accepted and implemented. The authentic Sunnah indicates that eating the Suhur is encouraged. It is reported in the Two Sahihs that Anas narrated that Allah's Messenger ﷺ said:
«تَسَحَّرُوا فَإِنَّ فِي السَّحُورِ بَرَكَة»
(Eat the Suhur, for there is a blessing in Suhur.)
Muslim reported that `Amr bin Al-`As narrated that Allah's Messenger ﷺ said:
«إِنَّ فَصْلَ مَا بَيْنَ صِيَامِنَا وصِيَامِ أَهْلِ الْكِتَابِ أَكْلَةُ السَّحَر»
(The distinction between our fast and the fast of the People of the Book is the meal of Suhur.)
Imam Ahmad reported that Abu Sa`id narrated that Allah's Messenger ﷺ said:
«السَّحُورُ أَكْلُهُ بَرَكَةٌ فَلَا تَدَعُوهُ، وَلَوْ أَنَّ أَحَدَكُمْ تَجْرَعُ جُرْعَةَ مَاءٍ، فَإِنَّ اللهَ وَمَلَائِكَتَهُ يُصَلُّون عَلَى الْمُتَسَحِّرِين»
(Suhur is a blessed meal. Hence, do not abandon it, even if one just takes a sip of water. Indeed, Allah and His angels send Salah (blessings) upon those who eat Suhur.)
There are several other Hadiths that encourage taking the Suhur, even if it only consists of a sip of water.
It is preferred that Suhur be delayed until the time of dawn. It is recorded in the Two Sahihs that Anas bin Malik narrated that Zayd bin Thabit said, "We had Suhur with Allah's Messenger ﷺ and then went on to pray." Anas asked, "How much time was there between the Adhan (call to prayer) and the Suhur" He said, "The time that fifty Ayat take (to recite)."
Imam Ahmad recorded Abu Dharr saying that Allah's Messenger ﷺ said:
«لَا تَزَالُ أُمَّتِي بِخَيْرٍ مَا عَجَّلُوا الْإِفْطَارَ وَأَخَّرُوا السُّحُور»
(My Ummah will always retain goodness as long as they hasten in breaking the fast and delay the Suhur.)
There are several Hadiths that narrate that the Prophet called Suhur "the blessed meal."
There are narrations from several of the Salaf that they allowed the Suhur to be eaten later until close to Fajr. This is is reported from Abu Bakr, `Umar, `Ali, Ibn Mas`ud, Hudhayfah, Abu Hurayrah, Ibn `Umar, Ibn `Abbas and Zayd bin Thabit. It is also reported from many of the Tabi`in, such as Muhammad bin `Ali bin Husayn, Abu Mijlaz, Ibrahim An-Nakha`i, Abu Ad-Duha, Abu Wa'il and other companions of Ibn Mas`ud. This is also the opinion of `Ata', Al-Hasan, Hakam bin `Uyainah, Mujahid, `Urwah bin Az-Zubayr, Abu Sha`tha' Jabir bin Zayd, Al- A`mash and Ma`mar bin Rashid. We have mentioned the chains of narrations for their statements in our (Ibn Kathir's) book about Siyam (Fasting), and all praise is due to Allah.
It is also recorded in the Two Sahihs that Al-Qasim said that `A'ishah narrated that Allah's Messenger ﷺ said:
«لَا يَمْنَعُكُمْ أَذَانُ بِلَالٍ عَنْ سَحُورِكُمْ، فَإِنَّهُ يُنَادِي بِلَيْلٍ، فَكُلُوا وَاشْرَبُوا حَتَّى تَسْمَعُوا أَذَانَ ابْنِ أُمِّ مَكْتُومٍ، فَإِنَّهُ لاَ يُؤَذِّنُ حَتَّى يَطْلُعَ الْفَجْر»
(The Adhan pronounced by Bilal should not stop you from taking Suhur, for he pronounces the Adhan at night. Hence, eat and drink until you hear the Adhan by Ibn Umm Maktum, for he does not call the Adhan until dawn.)
This is the wording collected by Al-Bukhari.
Imam Ahmad reported that Qays bin Talq quoted from his father that Allah's Messenger ﷺ said:
«لَيْسَ الْفَجْرُ الْمُسْتَطِيلَ فِي الْأُفُقِ وَلَكِنِ الْمُعْتَرِضُ الْأَحْمَر»
(Dawn is not the (ascending) glow of white light of the horizon. Rather, it is the red (radiating) light.)
Abu Dawud and At-Tirmidhi also recorded this Hadith, but their wording is:
«كُلُوا واشْرَبُوا، وَلَا يَهِيدَنَّكُمُ السَّاطِعُ الْمُصْعِدُ، فَكُلُوا واشْرَبُوا حَتَّى يَعْتَرِضَ لَكُمُ الْأَحْمَر»
(Eat and drink and do not be rushed by the ascending (white) light. Eat and drink until the redness (of the dawn) appears.)
Ibn Jarir (At-Tabari) recorded that Samurah bin Jundub narrated that Allah's Messenger ﷺ said:
«لَا يَغُرَّنَّكُمْ أَذَانُ بِلَالٍ وَلَا هَذَا الْبَيَاضُ لِعَمُودِ الصُّبْحِ حَتَّى يَسْتَطِير»
(Do not be stopped by Bilal's Adhan or the (ascending) whiteness, until it spreads.) Muslim also recorded this Hadith.
Q: Is it "Haram" to begin fasting while "Junub"?
Answer to: "Is there harm in starting the month of fasting while junub?" is: NO.
Issue: Among the benefits of allowing sexual activity, eating and drinking until dawn for those who are fasting, is that it is allowed to start the fast while Junub (in the state of impurity after sexual discharge), and there is no harm in this case if one takes a bath any time in the morning after waking up, and completes the fast. This is the opinion of the Four Imams and the majority of the scholars. Al-Bukhari and Muslim recorded that `A'ishah and Umm Salamah said that Allah's Messenger ﷺ used to wake up while Junub from sexual intercourse, not wet dreams, and he would take a bath and fast. Umm Salamah added that he would not break his fast or make up for that day.
Muslim recorded that `A'ishah said that a man asked:
يَا رَسُولَ اللهِ، تُدْرِكُنِي الصَّلَاةُ وَأَنَا جَنُبٌ فَأَصُومُ؟ فَقَالَ رَسُولُ اللهِصلى الله عليه وسلّم:
«وَأَنَا تُدْرِكُنِي الصَّلاةُ وَأَنَا جُنُبٌ فَأَصُوم»
"O Messenger of Allah ﷺ! The (Dawn) prayer time starts while I am Junub, should I fast" Allah's Messenger ﷺ replied, (And I. The prayer time starts while I am Junub and I fast.)
He said, "You are not like us, O Messenger of Allah ﷺ! Allah has forgiven your previous and latter sins." Allah's Messenger ﷺ said:
«وَاللهِ إِنَّي لَأَرْجُو أَنْ أَكُونَ أَخْشَاكُمْ للهِ وَأَعْلَمَكُمْ بِمَا أَتَّقِي»
(By Allah! I hope that I have the most fear from Allah among you and the best knowledge of what Taqwa is.)
And Allah Knows Best
Question: "Does Fasting End Exactly at Sunset?"
Answer: Let us look to what Allah said:
ثُمَّ أَتِمُّواْ الصِّيَامَ إِلَى الَّيْلِ
(...then complete your fast till the nightfall.)
This Ayah orders breaking the fast at sunset. It is recorded in the Two Sahihs that `Umar bin Al-Khattab said that Allah's Messenger ﷺ said:
«إِذَا أَقْبَلَ اللَّيْلُ مِنْ ههُنَا، وَأَدْبَرَ النَّهَارُ مِنْ ههُنَا فَقَدْ أَفْطَرَ الصَّائِم»
(If the night comes from this direction (the east), and the day departs from that direction (the west), then the fasting person breaks his fast.)
It is reported that Sahl bin Sa`d As-Sa`idi narrated that Allah's Messenger ﷺ said:
«لَا يَزَالُ النَّاسُ بِخَيْرٍ مَا عَجَّلُوا الْفِطْر»
(The people will retain goodness as long as they hasten in breaking the fast.)
Imam Ahmad recorded that Abu Hurayrah narrated that the Prophet said:
«يَقُولُ اللهُ عَزَّ وَجَلَّ: إِنَّ أَحَبَّ عِبَادِي إِلَيَّ أَعْجَلُهُمْ فِطْرًا»
(Allah the Exalted said, `The dearest among My servants to Me are those who hasten in breaking the fast the most.')
At-Tirmidhi recorded this Hadith and said that this Hadith is Hasan Gharib.
Prohibition of Uninterrupted Fasting (Wisal)
There are several authentic Hadiths that prohibit Al-Wisal, which means continuing the fast through the night to the next night, without eating. Imam Ahmad recorded Abu Hurayrah saying that Allah's Messenger ﷺ said:
«لَا تُوَاصِلُوا»
قَالُوا: يَارَسُولَ اللهِ إِنَّكَ تُوَاصِلُ، قَالَ:
«فَإِنِّي لَسْتُ مِثْلَكُمْ إِنِّي أَبِيتُ يُطْعِمُنِي رَبِّي وَيَسْقِينِي»
(Do not practice Al-Wisal in fasting.) So, they said to him, "But you practice Al-Wisal, O Allah's Messenger ﷺ!" The Prophet replied, "(I am not like you, I am given food and drink during my sleep by my Lord.) ,So, when the people refused to stop Al-Wisal, the Prophet fasted two days and two nights (along with those who practiced Wisal) and then they saw the crescent moon (of the month of Shawwal). The Prophet said to them (angrily):
«لَوْ تَأَخَّرَ الْهِلَالُ لَزِدْتُكُم»
(If the crescent had not appeared, I would have made you fast for a longer period.)
That was as a punishment for them (when they refused to stop practicing Al-Wisal). This Hadith is also recorded in the Sahihayn.
The prohibition of Al-Wisal was also mentioned in a number of other narrations. It is a fact that practicing Al-Wisal was one of the special qualities of the Prophet , for he was capable and assisted in his practice of it. It is obvious that the food and drink that the Prophet used to get while practicing Al-Wisal was spiritual and not material, otherwise he would not be practicing Al-Wisal. We should mention that it is allowed to refrain from breaking the fast from sunset until before dawn (Suhur). A Hadith narrated by Abu Sa`id Khudri states that Allah's Messenger ﷺ said:
«لَا تُوَاصِلُوا فَأَيُّكُمْ أَرَادَ أَنْ يُوَاصِلَ فَلْيُوَاصِلْ إِلَى السَّحَر»
(Do not practice Al-Wisal, but whoever wishes is allowed to practice it until the Suhur.)
They said, "You practice Al-Wisal, O Messenger of Allah ﷺ!" He said:
«إِنِّي لَسْتُ كَهَيْئَتِكُمْ، إِنِّي أَبِيتُ لِي مُطْعِمٌ يُطْعِمُنِي وَسَاقٍ يَسْقِينِي»
(I am not similar to you, for I have One Who makes me eat and drink during the night.) This Hadith is also collected in the Two Sahihs.
The Rulings of I`tikaf
Allah said:
وَلاَ تُبَـشِرُوهُنَّ وَأَنتُمْ عَـكِفُونَ فِي الْمَسَـجِدِ
(And do not have sexual relations with them (your wives) while you are in I`tikaf in the Masjids.)
`Ali bin Abu Talhah reported that Ibn `Abbas said, "This Ayah is about the man who stays in I`tikaf at the mosque during Ramadan or other months, Allah prohibited him from touching (having sexual intercourse with) women, during the night or day, until he finishes his I`tikaf." Ad-Dahhak said, "Formerly, the man who practiced I`tikaf would go out of the mosque and, if he wished, would have sexual intercourse (with his wife). Allah then said:
وَلاَ تُبَـشِرُوهُنَّ وَأَنتُمْ عَـكِفُونَ فِي الْمَسَـجِدِ
(And do not have sexual relations with them (your wives) while you are in I`tikaf in the Masjids.) meaning, `Do not touch your wives as long as you are in I`tikaf, whether you were in the mosque or outside of it'." It is also the opinion of Mujahid, Qatadah and several other scholars, that the Muslims used to have sexual intercourse with the wife while in I`tikaf if they departed the mosque until the Ayah was revealed. Ibn Abu Hatim commented, "It was reported that Ibn Mas`ud, Muhammad bin Ka`b, Mujahid, `Ata' Al-Hasan, Qatadah, Ad-Dahhak, As-Suddi, Ar-Rabi` bin Anas and Muqatil said that the Ayah means, `Do not touch the wife while in I`tikaf."'
What Ibn Abu Hatim reported from these people is the agreed upon practice among the scholars. Those who are in I`tikaf are not allowed to have sexual intercourse as long as they are still in I`tikaf in the mosque. If one has to leave the mosque to attend to a need, such as to relieve the call of nature or to eat, he is not allowed to kiss or embrace his wife or to busy himself with other than his I`tikaf. He is not even allowed to visit ailing persons, but he can merely ask about their condition while passing by. I`tikaf has several other rulings that are explained in the books (of Fiqh), and we have mentioned several of these rulings at the end of our book on Siyam (Fasting), all praise is due to Allah. Furthermore, the scholars of Fiqh used to follow their explanation of the rules for fasting with the explanation of the rules for I`tikaf, as this is the way these acts of worship were mentioned in the Qur'an.
By mentioning I`tikaf after fasting, Allah draws attention to practicing I`tikaf during the month of the fast, especially the last part of the month. The Sunnah of Allah's Messenger ﷺ is that he used to perform I`tikaf during the last ten nights of the month of Ramadan until he died. Afterwards, the Prophet's wives used to perform I`tikaf as the Two Sahihs recorded from `A'ishah the Mother of the believers. It is reported in the Two Sahihs that Safiyyah, the daughter of Huyai, went to Allah's Messenger ﷺ to visit him in the mosque while he was in I`tikaf. She had a talk with him for a while, then she got up in order to return home. The Prophet accompanied her back home, as it was night. Her house was at Usamah bin Zayd's house on the edge of Al-Madinah. While they were walking, two Ansari men met them and passed by them in a hurry, for they were shy to bother the Prophet while he was walking with his wife. He told them:
«عَلى رِسْلِكُمَا، إِنَّهَا صَفِيَّةُ بِنْتُ حُيَي»
(Do not run away! She is (my wife) Safiyyah bint Huyai.) Both of them said, "All praise is due to Allah, (How dare we think of any evil) O Allah's Messenger ﷺ!" The Prophet said (to them):
«إِنَّ الشَّيْطَانَ يَجْرِي مِنِ ابْنِ آدَمَ مَجْرَى الدَّمِ، وَإِنِّي خَشِيتُ أَنْ يَقْذِفَ فِي قُلُوبِكُمَا شَيْئًا، أَوْ قَالَ: شَرًّا»
(Shaytan reaches everywhere in the human body, that the blood reaches. I was afraid lest Shaytan might suggest an evil thought in your minds.)
Imam Ash-Shafi`i commented, "Allah's Messenger ﷺ sought to teach his Ummah to instantly eliminate any evil thought, so that they do not fall into the prohibited. They (the two Ansari men) had more fear of Allah than to think evil of the Prophet . Allah knows best."
The Ayah (2:187) prohibits sexual intercourse and anything like kissing or embracing that might lead to it during I`tikaf. As for having the wife helping the husband, it is allowed. It is reported in the Two Sahihs that `A'ishah said, "Allah's Messenger ﷺ would bring his head near me (in her room) and I would comb his hair, while I was on my menses. He would enter the room only to attend to what a man needs."
Allah's statement:
تِلْكَ حُدُودُ اللَّهِ
(These are the limits (set) by Allah) means, `This is what We have explained, ordained, specified, allowed and prohibited for fasting. We also mentioned the fast's objectives, what is permitted during it, and what is required of it. These are the set limits that Allah has legislated and explained, so do not come near them or transgress them.' `Abdur-Rahman bin Zayd bin Aslam said, "(Allah's set limits mentioned in the Ayah) mean these four limits (and he then recited):
أُحِلَّ لَكُمْ لَيْلَةَ الصِّيَامِ الرَّفَثُ إِلَى نِسَآئِكُمْ
(It is made lawful for you to have sexual relations with your wives on the night of As-Siyam (fasting).) and he recited up to:
ثُمَّ أَتِمُّواْ الصِّيَامَ إِلَى الَّيْلِ
(then complete your Sawm (fast) till the nightfall.) My father and other's used to say similarly and recite the same Ayah to us."
Allah said:
كَذلِكَ يُبَيِّنُ اللَّهُ آيَاتِهِ لِلنَّاسِ
(Thus does Allah make clear His Ayat to mankind) meaning, `Just as He explains the fast and its rulings, He also explains the other rulings by the words of His servant and Messenger, Muhammad ﷺ .' Allah continues:
لِلنَّاسِ لَعَلَّهُمْ يَتَّقُونَ
(to mankind that they may attain Taqwa.) meaning, `So that they know how to acquire the true guidance and how to worship (Allah).' Similarly, Allah said:
هُوَ الَّذِى يُنَزِّلُ عَلَى عَبْدِهِ ءَايَـتٍ بَيِّنَـتٍ لِّيُخْرِجَكُمْ مِّنَ الظُّلُمَـتِ إِلَى النُّورِ وَإِنَّ اللَّهَ بِكُمْ لَرَءُوفٌ رَّحِيمٌ
(It is He Who sends down manifest Ayat to His servant (Muhammad ) that He may bring you out from (types of) darkness into the light. And verily, Allah is to you full of kindness, Most Merciful.) (57:9)
هذه رخصة من الله تعالى للمسلمين ورفع لما كان عليه الأمر في ابتداء الإسلام فإنه كان إذا أفطر أحدهم إنما يحل له الأكل والشرب والجماع إلى صلاة العشاء أو ينام قبل ذلك فمتى نام أو صلى العشاء حرم عليه الطعام والشراب والجماع إلى الليلة القابلة فوجدوا من ذلك مشقة كبيرة والرفث هنا هو الجماع قاله ابن عباس وعطاء ومجاهد وسعيد بن جبير وطاوس وسالم وعبدالله وعمرو بن دينار والحسن وقتادة والزهري والضحاك وإبراهيم النخعي والسدي وعطاء الخراساني ومقاتل بن حيان: وقوله "هن لباس لكم وأنتم لباس لهن" قال ابن عباس ومجاهد وسعيد بن جبير والحسن وقتادة والسدي ومقاتل بن حيان: يعني هن سكن لكم وأنتم سكن لهن وقال الربيع بن أنس: هن لحاف لكم وأنتم لحاف لهن وحاصله أن الرجل والمرأة كل منهما يخالط الآخر ويماسه ويضاجعه فناسب أن يرخص لهم في المجامعة في ليل رمضان لئلا يشق ذلك عليهم ويحرجوا قال الشاعر: إذا ما الضجيع ثنى جيدها تداعت فكانت عليه لباسا وكان السبب في نزول هذه الآية كما تقدم في حديث معاذ الطويل وقال أبو إسحاق عن البراء بن عازب قال: كان أصحاب النبي صلى الله عليه وسلم إذا كان الرجل صائما فنام قبل أن يفطر لم يأكل إلى مثلها وأن قيس بن صرمة الأنصاري كان صائما وكان يومه ذلك يعمل في أرضه فلما حضر الإفطار أتى امرأته فقال: هل عندك طعام؟ قالت: لا ولكن أنطلق فأطلب لك فغلبته عينه فنام وجاءت امرأته فلما رأته نائما قالت: خيبة لك أنمت؟ فلما انتصف النهار غشي عليه فذكر ذلك للنبي صلى الله عليه وسلم فنزلت هذه الآية "أحل لكم ليلة الصيام الرفث إلى نسائكم" -إلى قوله - "وكلوا واشربوا حتى يتبين لكم الخيط الأبيض من الخيط الأسود من الفجر" ففرحوا بها فرحا شديدا ولفظ البخاري ههنا من طريق أبي إسحاق سمعت البراء قال: لما نزل صوم رمضان كانوا لا يقربون النساء رمضان كله وكان رجال يخونون أنفسهم فأنزل الله "علم الله أنكم كنتم تختانون أنفسكم فتاب عليكم وعفا عنكم" وقال علي بن أبي طلحة عن ابن عباس قال: كان المسلمون في شهر رمضان إذا صلوا العشاء حرم عليهم النساء والطعام إلى مثلها من القابلة ثم إن أناسا من المسلمين أصابوا من النساء والطعام في شهر رمضان بعد العشاء منهم عمر بن الخطاب فشكوا ذلك إلى رسول الله صلى الله عليه وسلم فأنزل الله تعالى "علم الله أنكم كنتم تختانون أنفسكم فتاب عليكم وعفا عنكم فالآن باشروهن" الآية وكذا روى العوفي عن ابن عباس وقال موسى بن عقبة عن كريب عن ابن عباس قال: إن الناس كانوا قبل أن ينزل في الصوم ما نزل فيهم يأكلون ويشربون ويحل لهم شأن النساء فإذا نام أحدهم لم يطعم ولم يشرب ولا يأتي أهله حتى يفطر من القابلة فبلغنا أن عمر بن الخطاب بعدما نام ووجب عليه الصوم وقع على أهله ثم جاء إلى النبي صلى الله عليه وسلم فقال أشكوا إلى الله وإليك الذي صنعت قال "وما صنعت؟" قال إني سولت لي نفسي فوقعت على أهلي بعدما نمت وأنا أريد الصوم فزعموا أن النبي صلى الله عليه وسلم قال "ما كنت خليقا أن تفعل" فنزل الكتاب "أحل لكم ليلة الصيام الرفث إلى نسائكم" وقال سعيد بن أبي عروبة عن قيس بن سعد عن عطاء بن أبي رباح عن أبي هريرة في قول الله تعالى "أحل لكم ليلة الصيام الرفث إلى نسائكم - إلى قوله - ثم أتموا الصيام إلى الليل" قال كان المسلمون قبل أن تنزل هذه الآية إذا صلوا العشاء الآخرة حرم عليهم الطعام والشراب والنساء حتى يفطروا وأن عمر بن الخطاب أصاب أهله بعد صلاة العشاء وأن صرمة بن قيس الأنصاري غلبته عيناه بعد صلاة المغرب فنام ولم يشبع من الطعام ولم يستيقظ حتى صلى رسول الله صلى الله عليه وسلم العشاء فقام فأكل وشرب فلما أصبح أتى رسول الله صلى الله عليه وسلم فأخبره بذلك فأنزل الله عند ذلك"أحل لكم الصيام الرفث إلى نسائكم" يعني بالرفث مجامعة النساء "هن لباس لكم وأنتم لباس لهن" علم الله أنكم كنتم تختانون أنفسكم" يعني تجامعون النساء وتأكلون وتشربون بعد العشاء "فتاب عليكم وعفا عنكم فالآن باشروهن" يعني جامعوهن "وابتغوا ما كتب الله لكم" يعني الولد "وكلوا واشربوا حتى يتبين لكم الخيط الأبيض من الخيط الأسود من الفجر ثم أتموا الصيام إلى الليل" فكان ذلك عفوا من الله ورحمة وقال هشام عن حصين بن عبدالرحمن عن عبدالرحمن بن أبي ليلى قال: قام عمر بن الخطاب رضي الله عنه فقال: يا رسول الله إني أردت أهلي البارحة على ما يريد الرجل أهله فقالت إنها قد نامت فظننتها تعتل فواقعتها فنزل في عمر "أحل لكم ليلة الصيام الرفث إلى نسائكم" وهكذا رواه شعبة عن عمرو بن مرة عن ابن أبي ليلى به وقال أبو جعفر بن جرير: حدثني المثنى حدثنا سويد أخبرنا ابن المبارك عن ابن لهيعة حدثني موسى بن جبير مولى بني سلمة أنه سمع عبدالله بن كعب بن مالك يحدث عن أبيه قال: كان الناس في رمضان إذا صام الرجل فأمسى فنام حرم عليه الطعام والشراب والنساء حتى يفطر من الغد فرجع عمر بن الخطاب من عند النبي صلى الله عليه وسلم ذات ليلة وقد سمر عنده فوجد امرأته قد نامت فأرادها فقالت إني قد نمت فقال ما نمت ثم وقع بها وصنع كعب بن مالك مثل ذلك فغدا عمر بن الخطاب إلى النبي صلى الله عليه وسلم فأخبره فأنزل الله "علم الله أنكم كنتم تختانون أنفسكم فتاب عليكم وعفا عنكم فالآن باشروهن" الآية وهكذا روي عن مجاهد وعطاء وعكرمة وقتادة وغيرهم في سبب نزول هذه الآية في عمر بن الخطاب ومن صنع كما صنع وفي صرمة بن قيس فأباح الجماع والطعام والشراب في جميع الليل رحمة ورخصة ورفقا. وقوله "وابتغوا ما كتب الله لكم" قال أبو هريرة وابن عباس وأنس وشريح القاضي ومجاهد وعكرمة وسعيد بن جبير وعطاء والربيع بن أنس والسدي وزيد بن أسلم والحكم بن عتبة ومقاتل بن حيان والحسن البصري والضحاك وقتادة وغيرهم يعني الولد وقال عبدالرحمن بن زيد بن أسلم: "وابتغوا ما كتب الله لكم" يعني الجماع وقال عمرو بن مالك البكري عن أبي الجوزاء عن ابن عباس "وابتغوا ما كتب الله لكم" قال ليلة القدر رواه ابن أبي حاتم وابن جرير وقال عبد الرزاق: أخبرنا معمر قال: قال قتادة ابتغوا الرخصة التي كتب الله لكم يقول ما أحل الله لكم وقال عبد الرزاق أيضا: أخبرنا ابن عيينة عن عمرو بن دينار عن عطاء بن أبي رباح قال: قلت لابن عباس كيف تقرأ هذه الآية "وابتغوا ما كتب الله لكم" قال أيتهما شئت عليك بالقراءة الأولى واختار ابن جرير أن الآية أعم من هذا كله. وقوله "وكلوا واشربوا حتى يتبين لكم الخيط الأبيض من الخيط الأسود من الفجر ثم أتموا الصيام إلى الليل" أباح تعالى الأكل والشرب مع ما تقدم من إباحة الجماع في أي الليل شاء الصائم إلى أن يتبين ضياء الصباح من سواد الليل وعبر عن ذلك بالخيط الأبيض من الخيط الأسود ورفع اللبس بقوله "من الفجر" كما جاء في الحديث الذي رواه الإمام أبو عبدالله البخاري حدثني ابن أبي مريم حدثنا أبو غسان محمد بن مطرف حدثنا أبو حازم عن سهل بن سعد قال أنزلت "وكلوا واشربوا حتى يتبين لكم الخيط الأبيض من الخيط الأسود" ولم ينزل "من الفجر" وكان رجال إذا أرادوا الصوم ربط أحدهم في رجليه الخيط الأبيض والخيط الأسود فلا يزال يأكل حتى يتبين له رؤيتهما فأنزل الله بعد "من الفجر" فعلموا أنما يعني الليل والنهار وقال الإمام أحمد حدثنا هشام أخبرنا حصين عن الشعبي أخبرني عدي بن حاتم قال: لما نزلت هذه الآية "وكلوا واشربوا حتى يتبين لكم الخيط الأبيض من الخيط الأسود" عمدت إلى عقالين أحدهما أسود والآخر أبيض قال فجعلتهما تحت وسادتي قال فجعلت أنطر إليهما فلما تبين لي الأبيض من الأسود أمسكت فلما أصبحت غدوت إلى رسول الله صلى الله عليه وسلم فأخبرته بالذي صنعت فقال "إن وسادك إذا لعريض إنما ذلك بياض النهار من سواد الليل" أخرجاه في الصحيحين من غير وجه عن عدي. ومعنى قوله إن وسادك إذا لعريض أي إن كان ليسع الخيطين الخيط الأسود والأبيض المرادين من هذه الآية تحتها فإنهما بياض النهار وسواد الليل فيقتضي أن يكون بعرض المشرق والمغرب وهكذا وقع في رواية البخاري مفسرا بهذا حدثنا موسى بن إسماعيل حدثنا أبو عوانة عن حصين عن الشعبي عن عدي قال: أخذ عدي عقالا أبيض وعقالا أسود حتى كان بعض الليل نظر فلم يستبينا فلما أصبح قال يا رسول الله جعلت تحت وسادتي قال "إن وسادك إذا لعريض إن كان الخيط الأبيض والأسود تحت وسادتك" وجاء في بعض الألفاظ "إنك لعريض القفا" ففسره بعضهم بالبلادة وهو ضعيف بل يرجع إلى هذا لأنه إذا كان وساده عريضا فقفاه أيضا عريض والله أعلم ويفسره رواية البخاري أيضا حدثنا قتيبة حدثنا جرير عن مطرف عن الشعبي عن عدي بن حاتم قال: قلت يا رسول الله ما الخيط الأبيض من الخيط الأسود أهما الخيطان؟ قال "إنك لعريض القفا إن أبصرت الخيطين ثم قال لا بل هو سواد الليل وبياض النهار". وفي إباحته تعالى جواز الأكل إلى طلوع الفجر دليل على استحباب السحور لأنه من باب الرخصة والأخذ بها محبوب ولهذا وردت السنة الثابتة عن رسول الله صلى الله عليه وسلم بالحث على السحور ففي الصحيحين عن أنس قال: قال رسول الله صلى الله عليه وسلم "تسحروا فإن في السحور بركة" وفي صحيح مسلم عن عمرو بن العاص رضي الله عنه قال: قال رسول الله صلى الله عليه وسلم "إن فصل ما بين صيامنا وصيام أهل الكتاب أكلة السحور" وقال الإمام أحمد: حدثنا إسحاق بن عيسى هو ابن الطباع حدثنا عبدالرحمن بن زيد عن أبيه عن عطاء بن يسار عن أبي سعيد قال: قال رسول الله صلى الله عليه وسلم "السحور أكلة بركة فلا تدعوه ولو أن أحدكم تجرع جرعة من ماء فإن الله وملائكته يصلون على المتسحرين" وقد ورد في الترغيب في السحور أحاديث كثيرة حتى ولو بجرعة من ماء تشبها بالآكلين ويستحب تأخيره إلى وقت انفجار الفجر كما جاء في الصحيحين عن أنس بن مالك عن زيد بن ثابت قال تسحرنا مع رسول الله صلى الله عليه وسلم ثم قمنا إلى الصلاة قال أنس قلت لزيد كم كان بين الأذان والسحور؟ قال قدر خمسين آية وقال الإمام أحمد حدثنا موسى بن داود حدثنا ابن لهيعة عن سالم بن غيلان عن سليمان بن أبي عثمان عن عدي بن حاتم الحمصي عن أبي ذر قال: قال رسول الله صلى الله عليه وسلم "لا تزال أمتي بخير ما عجلوا الإفطار وأخروا السحور" وقد ورد أحاديث كثيرة أن رسول الله صلى الله عليه وسلم سماه الغداء المبارك وفي الحديث الذي رواه الإمام أحمد والنسائي وابن ماجه من رواية حماد بن سلمة عن عاصم بن بهدلة عن زيد بن حبيش عن حذيفة قال: تسحرنا مع رسول الله صلى الله عليه وسلم وكان النهار إلا أن الشمس لم تطلع وهو حديث تفرد به عاصم بن أبي النجود قاله النسائي وحمله على أن المراد قرب النهار كما قال تعالى "فإذا بلغن أجلهن فأمسكوهن بمعروف أو فارقوهن بمعروف" أي قاربن انقضاء العدة فإما إمساك بمعروف أو ترك للفراق وهذا الذي قاله هو المتعين حمل الحديث عليه أنهم تسحروا ولم يتيقنوا طلوع الفجر حتى أن بعضهم ظن طلوعه وبعضهم لم يتحقق ذلك وقد روي عن طائفة كثيرة من السلف أنهم تسامحوا في السحور عند مقاربة الفجر روي مثل هذا عن أبي بكر وعمر وعلي وابن مسعود وحذيفة وأبي هريرة وابن عمر وابن عباس وزيد بن ثابت وعن طائفة كثيرة من التابعين منهم محمد بن علي بن الحسين وابن مجلز وإبراهيم النخعي وأبو الضحى وأبو وائل وغيره من أصحاب ابن مسعود وعطاء والحسن والحاكم بن عيينة ومجاهد وعروة بن الزبير وأبو الشعثاء جابر بن زيد وإليه ذهب الأعمش وجابر بن راشد وقد حررنا أسانيد ذلك في كتاب الصيام المفرد ولله الحمد وحكى أبو جعفر بن جرير في تفسيره عن بعضهم أنه إنما يجب الإمساك من طلوع الشمس كما يجوز الإفطار بغروبها "قلت" وهذا القول ما أظن أحدا من أهل العلم يستقر له قدم عليه لمخالفته نص القرآن في قوله "وكلوا واشربوا حتى يتبين لكم الخيط الأبيض من الخيط الأسود من الفجر ثم أتموا الصيام إلى الليل" وقد ورد في الصحيحين من حديث القاسم عن عائشة أن رسول الله صلى الله عليه وسلم قال "لا يمنعكم أذان بلال عن سحوركم فإنه ينادي بليل فكلوا واشربوا حتى تسمعوا أذان ابن أم مكتوم فإنه لا يؤذن حتى يطلع الفجر" لفظ البخاري وقال الإمام أحمد حدثنا موسى بن داود حدثنا محمد بن جابر عن قيس بن طلق عن أبيه أن رسول الله صلى الله عليه وسلم قال: "ليس الفجر المستطيل في الأفق ولكنه المعترض الأحمر" ورواه الترمذي ولفظهما "كلوا واشربوا ولا يهيدنكم الساطع المصعد فكلوا واشربوا حتى يعترض لكم الأحمر" وقال ابن جرير: حدثنا محمد بن المثنى حدثنا عبدالرحمن بن مهدي حدثنا شعبة عن بني قشير سمعت سمرة بن جندب يقول: قال رسول الله صلى الله عليه وسلم "لا يغرنكم نداء بلال وهذا البياض حتى ينفجر الفجر أو يطلع الفجر" ثم رواه من حديث شعبة وغيره عن سواد بن حنظلة عن سمرة قال: قال رسول الله صلى الله عليه وسلم "لا يمنعكم من سحوركم أذان بلال ولا الفجر المستطيل ولكنه الفجر المستطير في الأفق" قال وحدثني يعقوب بن إبراهيم ابن علية عن عبدالله بن سودة القشيري عن أبيه عن سمرة بن جندب قال: قال رسول الله صلى الله عليه وسلم "لا يغرنكم أذان بلال ولا هذا البياض - لعمود الصبح - حتى يستطير" رواه مسلم في صحيحه عن زهير بن حرب عن إسماعيل بن إبراهيم هو ابن علية مثله سواء وقال ابن جرير حدثنا ابن حميد حدثنا ابن المبارك عن سليمان التيمي عن أبي عثمان النهدي عن ابن مسعود قال: قال رسول الله صلى الله عليه وسلم "لا يمنعن أحدكم أذان بلال عن سحوره - أو قال - نداء بلال فإن بلالا يؤذن بليل - أو قال - ينادي لينبه نائمكم وليرجع قائمكم وليس الفجر أن يقول هكذا وهكذا حتى يقول هكذا" ورواه من وجه آخر عن التيمي به وحدثني الحسن بن الزبرقان النخعي حدثنا أبو أسامة عن محمد بن أبي ذئب عن الحارث بن عبدالرحمن عن محمد بن عبدالرحمن بن ثوبان قال: قال رسول الله صلى الله عليه وسلم "الفجر فجران فالذي كأنه ذنب السرحان لا يحرم شيئا وإنما هو المستطير الذي يأخذ الأفق فإنه يحل الصلاة ويحرم الطعام" وهذا مرسل جيد وقال عبد الرزاق: أخبرنا ابن جريج عن عطاء سمعت ابن عباس يقول: هما فجران فأما الذي يسطع فى السماء فليس يحل ولا يحرم شيئا ولكن الفجر الذي يستنير على رءوس الجبال هو الذي يحرم الشراب وقال عطاء: فأما إذا سطع سطوعا في السماء وسطوعه أن يذهب في السماء طولا فإنه لا يحرم به شراب للصائم ولا صلاة ولا يفوت به الحج ولكن إذا انتشر على رؤوس الجبال حرم الشراب للصيام وفات الحج وهذا إسناد صحيح إلى ابن عباس وعطاء وهكذا روي عن غير واحد من السلف رحمهم الله "مسألة" ومن جعله تعالى الفجر غاية لإباحة الجماع والطعام والشراب لمن أراد الصيام يستدل على أنه من أصبح جنبا فليغتسل وليتم صومه ولا حرج عليه وهذا مذهب الأئمة الأربعة وجمهور العلماء سلفا وخلفا لما رواه البخاري ومسلم من حديث عائشة وأم سلمة رضي الله عنهما أنهما قالتا: كان رسول الله صلى الله عليه وسلم يصبح جنبا من جماع غير احتلام ثم يغتسل ويصوم وفي حديث أم سلمة عندهما ثم لا يفطر ولا يقضي وفي صحيح مسلم عن عائشة أن رجلا قال: يا رسول الله تدركني الصلاة وأنا جنب فأصوم؟ فقال رسول الله صلى الله عليه وسلم "وأنا تدركني الصلاة وأنا جنب فأصوم" فقال لست مثلنا يا رسول الله قد غفر الله لك ما تقدم من ذنبك وما تأخر فقال "والله إني لأرجو أن أكون أخشاكم لله وأعلمكم بما أتقي" فأما الحديث الذي رواه الإمام أحمد حدثنا عبد الرزاق عن معمر عن همام عن أبي هريرة عن رسول الله صلى الله عليه وسلم أنه قال: "إذا نودي للصلاة صلاة الصبح وأحدكم جنب فلا يصم يومئذ" فإنه حديث جيد الإسناد على شرط الشيخين كما ترى وهو في الصحيحين عن أبي هريرة عن الفضل بن عباس عن النبي صلى الله عليه وسلم وفي سنن النسائي عنه عن أسامة بن زيد والفضل بن عباس ولم يرفعه فمن العلماء من علل هذا الحديث بهذا ومنهم من ذهب إليه ويحكى هذا عن أبي هريرة وسالم وعطاء وهشام بن عروة والحسن البصري ومنهم من ذهب إلى التفرقة بين أن يصبح جنبا نائما فلا عليه لحديث عائشة وأم سلمة أو مختارا فلا صوم له لحديث أبي هريرة يحكى هذا عن عروة وطاوس والحسن ومنهم من فرق بين الفرض فيتم فيقضيه وأما النفل فلا يضره رواه الثوري عن منصور عن إبراهيم النخعي وهو رواية عن الحسن البصري أيضا ومنهم من ادعى نسخ حديث أبي هريرة بحديثي عائشة وأم سلمة ولكن لا تاريخ معه وادعى ابن حزم أنه منسوخ بهذه الآية وهو بعيد أيضا إذ لا تاريخ بل الظاهر من التاريخ خلافه ومنهم من حمل حديث أبي هريرة على نفي الكمال فلا صوم له لحديث عائشة وأم سلمة الدالين على الجواز وهذا المسلك أقرب الأقوال وأجمعها والله أعلم وقوله "ثم أتموا الصيام إلى الليل" يقتضي الإفطار عند غروب الشمس حكما شرعيا كما جاء في الصحيحين عن أمير المؤمنين عمر بن الخطاب رضي الله عنه قال: قال رسول الله صلى الله عليه وسلم "إذا أقبل الليل من ههنا وأدبر النهار من ههنا فقد أفطر الصائم" وعن سهل بن سعد الساعدي رضي الله عنه قال: قال رسول الله صلى الله عليه وسلم "لا يزال الناس بخير ما عجلوا الفطر" أخرجاه وقال الإمام أحمد: حدثنا الوليد بن مسلم حدثنا الأوزاعي حدثنا قرة بن عبدالرحمن عن الزهري عن أبي سلمة عن أبي هريرة عن النبي صلى الله عليه وسلم يقول الله عز وجل "إن أحب عبادي إلي أعجلهم فطرا" ورواه الترمذي من غير وجه عن الأوزاعي به وقال هذا حديث حسن غريب وقال أحمد أيضا: حدثنا عفان حدثنا عبدالله بن إياد سمعت إياد بن لقيط سمعت ليلى امرأة بشير بن الخصاصية قالت: أردت أن أصوم يومين مواصلة فمنعني بشير وقال إن رسول الله صلى الله عليه وسلم نهى عنه وقال "يفعل ذلك النصارى ولكن صوموا كما أمركم الله ثم أتموا الصيام إلى الليل فإذا كان الليل فأفطروا" ولهذا ورد في الأحاديث الصحيحة النهي عن الوصال وهو أن يصل يوما بيوم آخر ولا يأكل بينهما شيئا قال الإمام أحمد: حدثنا عبد الرزاق حدثنا معمر عن الزهري عن أبي سلمة عن أبي هريرة قال قال رسول الله صلى الله عليه وسلم "لا تواصلوا" قالوا: يا رسول الله إنك تواصل قال "فإني لست مثلكم إني أبيت يطعمني ربي ويسقيني" قال فلم ينتهوا عن الوصال فواصل بهم النبي صلى الله عليه وسلم يومين وليلتين ثم رأوا الهلال فقال "لو تأخر الهلال لزدتكم" كالمنكل لهم وأخرجاه في الصحيحين من حديث الزهري به وكذلك أخرجا النهى عن الوصال من حديث أنس وابن عمر وعن عائشة رضي الله عنها قالت: نهي رسول الله صلى الله عليه وسلم عن الوصال رحمة لهم فقالوا إنك تواصل قال "إني لست كهيئتكم إني يطعمني ربي ويسقيني" فقد ثبت النهي عنه من غير وجه وثبت أنه من خصائص النبي صلى الله عليه وسلم وأنه كان يقوى على ذلك ويعان والأظهر أن ذلك الطعام والشراب في حقه إنما كان معنويا لا حسيا وإلا فلا يكون مواصلا مع الحسي ولكن كما قال الشاعر: لها أحاديث من ذكراك تشغلها عن الشراب وتلهيها عن الزاد وأما من أحب أن يمسك بعد غروب الشمس إلى وقت السحر فله ذلك كما في حديث أبي سعيد الخدري رضي الله عنه قال: قال رسول الله صلى الله عليه وسلم "لا تواصلوا فأيكم أراد أن يواصل فليواصل إلى السحر" قالوا: فإنك تواصل يا رسول الله قال "إني لست كهيئتكم إني أبيت لي مطعم يطعمني وساق يسقيني" أخرجاه في الصحيحين أيضا وقال ابن جرير حدثنا أبو كريب حدثنا أبو نعيم حدثنا أبو إسرائيل العنسي عن أبي سكر بن حفص عن أم ولد حاطب بن أبي بلتعة أنها مرت برسول الله صلى الله عليه وسلم وهو يتسحر فدعاها إلى الطعام فقالت إني صائمة قال وكيف تصومين فذكرت ذلك للنبي صلى الله عليه وسلم فقال "أين أنت من وصال آل محمد من السحر إلى السحر" وقال الإمام أحمد: حدثنا عبد الرزاق حدثنا إسرائيل عن عبد الأعلى عن محمد بن علي عن علي أن النبي صلى الله عليه وسلم كان يواصل من السحر إلى السحر وقد روى ابن جرير عن عبدالله بن الزبير وغيره من السلف أنهم كانوا يواصلون الأيام المتعددة وحمله منهم على أنهم كانوا يفعلون ذلك رياضة لأنفسهم لا أنهم كانوا يفعلونه عبادة والله أعلم ويحتمل أنهم كانوا يفهمون من النهي أنه إرشاد من باب الشفقة كما جاء في حديث عائشة رحمة له فكان ابن الزبير وابنه عامر ومن سلك سبيلهم يتجشمون ذلك ويفعلونه لأنهم كانوا يجدون قوة عليه وقد ذكر عنهم أنهم كانوا أول ما يفطرون على السمن والصبر لئلا تتخرق الأمعاء بالطعام أولا وقد روي عن ابن الزبير أنه كان يواصل سبعة أيام ويصبح في اليوم السابع أقواهم وأجلدهم وقال أبو العالية إنما فرض الله الصيام بالنهار فإذا جاء بالليل فمن شاء أكل ومن شاء لم يأكل وقوله تعالى "ولا تباشروهن وأنتم عاكفون في المساجد" قال علي بن أبي طلحة عن ابن عباس هذا في الرجل يعتكف في المسجد في رمضان أو في غير رمضان فحرم الله عليه أن ينكح النساء ليلا أو نهارا حتى يقضي اعتكافه وقال الضحاك كان الرجل إذا اعتكف فخرج من المسجد جامع إن شاء فقال الله تعالى "ولا تباشروهن" وأنتم عاكفون في المساجد" أي لا تقربوهن ما دمتم عاكفين في المسجد ولا في غيره. وكذا قال مجاهد وقتادة وغير واحد إنهم كانوا يفعلون ذلك حتى نزلت هذه الآية. قال ابن أبي حاتم روي عن ابن مسعود ومحمد بن كعب ومجاهد وعطاء والحسن وقتادة والضحاك والسدي والربيع بن أنس ومقاتل: قالوا لا يقربها وهو معتكف وهذا الذي حكاه عن هؤلاء هو الأمر المتفق عليه عند العلماء أن المعتكف يحرم عليه النساء ما دام معتكفًا في مسجده ولو ذهب إلى منزله لحاجة لا بد له منها فلا يحل له أن يثبت فيه إلا بمقدار ما يفرغ من حاجته تلك من قضاء الغائط أو الأكل وليس له أن يقبل امرأته ولا أن يضمها إليه ولا يشتغل بشيء سوى اعتكافه ولا يعود المريض لكن يسأل عنه وهو مار في طريقه وللاعتكاف أحكام مفصلة في بابها منها ما هو مجمع عليه بين العلماء ومنها ما هو مختلف فيه. وقد ذكرنا قطعة صالحة من ذلك في آخر كتاب الصيام وللّه الحمد والمنة ولهذا كان الفقهاء المصنفون يتبعون كتاب الصيام بكتاب الاعتكاف اقتداء بالقرآن العظيم فإنه نبه على ذكر الاعتكاف بعد ذكر الصوم. وفي ذكره تعالى الاعتكاف بعد الصيام إرشاد وتنبيه على الاعتكاف في الصيام أو في آخر شهر الصيام كما ثبتت السنة عن رسول الله - صلى الله عليه وسلم - أنه كان يعتكف العشر الأواخر من شهر رمضان حتى توفاه الله عز وجل ثم اعتكف أزواجه من بعده أخرجاه من حديث عائشة أم المؤمنين رضي الله عنها وفي الصحيحين أن صفية بنت حيي كانت تزور النبي - صلى الله عليه وسلم - وهو معتكف في المسجد فتحدثت عنده ساعة ثم قامت لترجع إلى منزلها وكان ذلك ليلا فقام النبي - صلى الله عليه وسلم - ليمشي معها حتى تبلغ دارها وكان منزلها في دار أسامة بن زيد في جانب المدينة فلما كان ببعض الطريق لقيه رجلان من الأنصار فلما رأيا النبي - صلى الله عليه وسلم - أسرعا وفي رواية تواريا أي حياء من النبي - صلى الله عليه وسلم - لكون أهله معه فقال لهما - صلى الله عليه وسلم - "على رسلكما إنها صفية بنت حيي" أي لا تسرعا واعلما أنها صفية بنت حيي أي زوجتي فقالا سبحان الله يا رسول الله فقال - صلى الله عليه وسلم - "إن الشيطان يجري من ابن آدم مجرى الدم وإني خشيت أن يقذف في قلوبكما شيئا - أو قال - شرا" قال الشافعي رحمه الله أراد عليه السلام أن يعلم أمته التبري من التهمة في محلها لئلا يقعا في محذور وهما كانا أتقى لله من أن يظنا بالنبي - صلى الله عليه وسلم - شيئا والله أعلم ثم المراد بالمباشرة إنما هو الجماع ودواعيه من تقبيل ومعانقة ونحو ذلك فأما معاطاة الشيء ونحوه فلا بأس به فقد ثبت في الصحيحين عن عائشة رضي الله عنها أنها قالت كان رسول الله - صلى الله عليه وسلم - يدني إلي رأسه فأرجله وأنا حائض وكان لا يدخل البيت إلا لحاجة الإنسان قالت عائشة ولقد كان المريض يكون في البيت فما أسال عنه إلا وأنا مارة وقوله "تلك حدود الله" أي هذا الذي بيناه وفرضناه وحددناه من الصيام وأحكامه وما أبحنا فيه وما حرمنا وذكرنا غاياته ورخصه وعزائمه حدود الله أي شرعها الله وبينها بنفسه فلا تقربوها أي لا تجاوزوها وتتعدوها وكان الضحاك ومقاتل يقولان في قوله "تلك حدود الله" أي المباشرة في الاعتكاف وقال عبدالرحمن بن زيد بن أسلم يعني هذه الحدود الأربعة ويقرأ "أحل لكم ليلة الصيام الرفث إلى نسائكم" حتى بلغ "ثم أتموا الصيام إلى الليل" قال وكان أبي وغيره من مشيختنا يقولون هذا ويتلونه علينا "كذلك يبين الله آياته للناس" أي كما بين الصيام وأحكامه وشرائعه وتفاصيله كذلك يبين سائر الأحكام على لسان عبده ورسوله محمد - صلى الله عليه وسلم - "للناس لعلهم يتقون" أي يعرفون كيف يهتدون وكيف يطيعون كما قال تعالى "هو الذي ينزل على عبده آيات بينات ليخرجكم من الظلمات إلى النور وإن الله بكم لرءوف رحيم".
(It is made lawful for you to go unto your wives on the night of the fast) for sexual intercourse. (They are raiment for you) a repose for you (and you are raiment for them) a repose for them. (Allah is aware that ye were deceiving yourselves in this respect) by having sexual intercourse with them at night (and He hath turned in mercy towards you) He forgave you (and relieved you) from your deception and did not punish you. (So) now that it is made lawful, (hold intercourse with them and seek that which Allah hath ordained for you) to have a righteous child; this verse was revealed about 'Umar Ibn al-Khattab, (and eat and drink) from the time the night falls (until the white thread becometh distinct to you from the black thread of the dawn) i.e. until the light of day becomes distinct to you from the darkness of night. (Then strictly observe the fast till nightfall) the beginning of nightfall; this verse was revealed about Sirmah Ibn Malik Ibn 'Adiyy (and touch them not) do not have sexual intercourse with them, (while you are at your devotions) in pious retreat (in the mosques) whether this is during the day or the night. (These are the limits imposed by Allah) such sexual intercourse is a transgression against Allah, (so approach them not) abstain from having sexual intercourse with your wives, during the day and at night, while you are in such retreats. (Thus Allah expoundeth His revelations) His commands and prohibitions (to mankind) as He has exposited this matter (that they may ward off (evil)) they may ward off transgressing against Him. This verse was revealed about a group of Companions of Allah's Messenger (pbuh) among whom were 'Ali Ibn Abi Talib and 'Ammar Ibn Yasir, who were in retreat in the mosque and used to go to their wives whenever they needed them, and then take a ritual bath and return to the mosque. Henceforth but they were forbidden to do so.
انتقال في أحكام الصيام إلى بيان أعمال في بعض أزمنة رمضان قد يظن أنها تنافي عبادة الصيام ، ولأجل هذا الانتقال فُصلت الجملة عن الجمل السابقة .وذكروا لسبب نزول هذه الآية كلاماً مضطرباً غير مُبيّن فروى أبو داود عن معاذ بن جبل كان المسلمون إذا نام أحدهم إذا صلى العِشاء وسهر بعدها لم يأكل ولم يباشر أهله بعد ذلك فجاء عُمر يريد امرأتْه فقالت : إني قد نمت فظن أنها تعْتَلُّ فباشرها ، وروى البخاري عن البراء بن عازب أن قيس بن صرمة جاء إلى منزله بعد الغروب يريد طعامه فقالت له امرأته : حتى نسخنَ لك شيئاً فنام فجاءت امرأته فوجدته نائماً فقالت : خيبةً لم فبقي كذلك فلما انتصف النهار أغمي عليه من الجوع ، وفي كتاب التفسير من صحيح البخاري أُحِلَّ لَكُمْ لَيْلَةَ الصيام الرفث إلى نِسَآئِكُمْ هُنَّ لِبَاسٌ لَّكُمْ وَأَنتُمْ لِبَاسٌ لَّهُنَّ عَلِمَ الله أَنَّكُمْ كُنتُمْ تَخْتانُونَ أَنفُسَكُمْ فَتَابَ عَلَيْكُمْ وَعَفَا عَنكُمْ فالن باشروهن وابتغوا مَا كَتَبَ الله لَكُمْ } عن حديث البراء بن عاوب قال : لما نزل صوم رمضان كانوا لا يقربون النساء رمضان كله وكان رجال يخونون أنفسهم فأنزل الله تعالى : { علم الله أنكم كنتم تختانون أنفسكم } الآية ، ووقع لكعب بن مالك مثل ما وقع لعمر ، فنزلت هذه الآية بسبب تلك الأحداث ، فقيل : كان ترك الأكل ومباشرة النساء من بعد النوم أو من بعد صلاة العشاء حكماً مشروعاً بالسُّنة ثم نسخ ، وهذا قول جمهور المفسرين ، وأنكر أبو مسلم الأصفهاني أن يكون هذا نسخاً لشيء تقرر في شرعنا وقال : هو نسخ لما كان في شريعة النصارى .وما شرع الصوم إلاّ إمساكاً في النهار دون الليل فلا أحسب أن الآية إنشاء للإباحة ولكنها إخبار عن الإباحة المتقررة في أصل توقيت الصيام بالنهار ، والمقصود منها إبطال شيء توهمه بعض المسلمين وهو أن الأكل بين الليل لا يتجاوز وقتين وقت الإفطار ووقت السحور وجعلوا وقت الإفطار هو ما بين المغرب إلى العشاء ، لأنهم كانوا ينامون إثر صلاة العشاء وقيامها فإذا صلوا العشاء لم يأكلوا إلاّ أكلة السحور وأنهم كانوا في أمر الجماع كشأنهم في أمر الطعام وأنهم لما اعتادوا جعل النوم مبدأ وقت الإمساك الليلي ظنوا أن النوم إن حصل في غير إبانة المعتاد يكون أيضاً مانعاً من الأكل والجماععِ إلى وقت السحور وإن وقت السحور لا يباح فيه إلاّ الأكل دون الجماع؛ إذ كانوا يتأثمون من الإصباح في رمضان على جنابة ، وقد جاء في «صحيح مسلم» أن أبا هريرة كان يرى ذلك يعني بعد وفاة رسول الله صلى الله عليه وسلم لعل هذا قد سرى إليْهم من أهل الكتاب كما يقتضيه ما رواه محمد بن جرير من طريق السدي ، ولعلهم التزموا ذلك ولم يسألوا عنه رسول الله صلى الله عليه وسلم ولعل ذلك لم يتجاوز بعض شهر رمضان من السنة التي شرع لهم فيها صيام رمضان فحدثت هذه الحوادث المختلفة المتقاربة ، وذكر ابن العربي في «العارضة» عن ابن القاسم عن مالك كان في أول الإسلام من رقد قبل أن يَطْعَم لم يَطعم من الليل شيئاً فأنزل الله : { فالئن باشروهن } فأكلوا بعد ذلك فقوله تعالى : { علم الله } دليل على أن القرآن نزل بهذا الحكم لزيادة البيان؛ إذ علم الله ما ضيق به بعض المسلمين على أنفسهم وأوحى به إلى رسوله صلى الله عليه وسلم وهذا يشير إلى أن المسلمين لم يُفشوا ذلك ولا أخبروا به رسول الله ولذلك لا نجد في روايات البخاري والنسائي أن الناس ذكروا ذلك لرسول الله إلاّ في حديث قيْس بن صِرمة عند أبي داود ولعله من زيادات الراوي .فأَما أن يكون ذلك قد شرع ثم نسخ فلا أحسبه ، إذ ليس من شأن الدين الذي شرع الصوم أولَ مرة يوماً في السنة ثم درَّجه فشرع الصوم شهراً على التخيير بينه وبين الإطعام تخفيفاً على المسلمين أن يفرضه بعد ذلك ليلاً ونهاراً فلا يبيح الفطر إلاّ ساعات قليلة من الليل .ولَيْلةُ الصيام الليلةُ التي يعقبها صيام اليوم الموالي لها جرياً على استعمال العرب في إضافة الليلة لليوم الموالي لها إلاّ ليلةَ عرفة فإن المراد بها الليلة التي بعد يوم عرفة .والرَّفث في «الأساس» و«اللسان» أن حقيقته الكلام مع النساء في شؤون الالتذاذ بهن ثم أطلق على الجماع كناية ، وقيل هو حقيقة فيهما وهو الظاهر ، وتعديته بإلى ليتعين المعنى المقصود وهو الإفضاء .وقول : { هن لباس لكم } جملة مستأنفة كالعلة لما قبلها أي أحل لعُسر الاحتراز عن ذلك ، ذلك أن الصوم لو فرض على الناس في الليل وهو وقت الاضطجاع لكان الإمساك عن قربان النساء في ذلك الوقت عنتاً ومشقة شديدة ليست موجودة في الإمساك عن قربانهن في النهار؛ لإمكان الاستعانة عليه في النهار بالبعد عن المرأة ، فقوله تعالى : { هن لباس لكم } استعارة بجامع شدة الاتصال حينئذٍ وهي استعارة أحياها القرآن ، لأن العرب كانت اعتبرتها في قوله : لابَسَ الشيءُ الشيءَ ، إذا اتصل به لكنهم صيروها في خصوص زنة المفاعلة حقيقةً عُرفية فجاء القرآن فأحياها وصيَّرها استعارة أَصلية جديدة بعد أن كانت تبعية منسية وقريبٌ منها قول امرىء القيس: ... فسُلِّي ثيابي من ثيابككِ تَنْسِللِو { تختانون } قال الراغب : «الاختيان مراودة الخيانة» بمعنى أنه افتعال من الخون وأصله تَخْتَوِنُون فصارت الواو ألِفاً لتحركها وانفتاح ما قبلها ، وخيانة الأنفس تمثيل لتكليفها ما لم تكلف به كأنَّ ذلك تعزيرٌ بها؛ إذ يوهمها أن المشقة مشروعة عليها وهي ليست بمشروعة ، وهو تمثيل لمغالطتها في الترخص بفعل ما ترونه محرماً عليكم فتُقْدِمُون تارة وتحجمون أخرى كمن يحاول خيانة فيكون كالتمثيل في قوله تعالى :{ يخادعون } [ البقرة : 9 ] .والمعنى هنا أنكم تلجئونها للخيانة أو تنسبونها لها ، وقيل : الاختيان أشد من الخيانة كالاكتساب والكَسب كما في «الكشاف» قلت : وهو استعمال كما قال تعالى : { ولا تجادل عن الذين يختانون أنفسهم } [ النساء : 107 ] .وقوله تعالى : { فالئن باشروهن } الأمر للإباحة ، وليس معنى قوله { فالئن } إشارة إلى تشريع المباشرة حينئذٍ بل معناه فاللآن اتضح الحكم فباشروهن ولا تختانوا أنفسكم . والابتغاء الطلب ، وما كتبه الله : ما أباحه من مباشرة النساء في غير وقت الصيام أو اطلبوا ما قدر الله لكم من الولد تحريضاً للناس على مباشرة النساء عسى أن يتكون النسل من ذلك وذلك لتكثير الأمة وبقاء النوع في الأرض .عطف على { باشروهن } ، والخيط سلك الكتان أو الصوف أو غيرهما يلفق به بين الثياب بشدة بإبرة أو مِخْيَطٍ ، يقال خاط الثوب وخَيَّطه . وفي خبر قبور بني أمية أنهم وجدوا معاوية رضي الله عنه في قبره كالخيط ، والخيط هنا يراد به الشعاع الممتد في الظلام والسوادُ الممتد بجانبه قال أبو دؤاد من شعراء الجاهلية: ... فَلَمَّا أَضَاءَت لَنَا سَدْفَةٌ ( )ولاَحَ من الصُّبْح خَيْطٌ أَنَارَا ... وقوله : { من الفجر } منْ ابتدائية أي الشعاع الناشىء عن الفجر ، وقيل بيانية وقيل تبعيضية وكذلك قول أبي دُؤَاد «من الصبح» لأن الخيط شائع في السلك الذي يخاط به فهو قرينة إحدى المعنيين للمشترك ، وجعله في «الكشاف» تشبيهاً بليغاً ، فلعله لم يثبت عنده اشتهار إطلاقه على هذا المعنى في غير بعض الكلام ، كالآية وبيت أبي دُؤاد ، وعندي أن القرآن ما أطلقه إلاّ لكونه كالنص في المعنى المراد في اللغة الفصحى دون إرادة التشبيه لأنه ليس بتشبيه واضح .وقد جيء في الغاية بحتى وبالتَّبَيُّن للدلالة على أن الإمساك يكون عند اتضاح الفجر للناظر وهو الفجر الصادق ، ثم قوله تعالى : { حتى يتبين } تحديد لنهاية وقت الإفطار بصريح المنطوق؛ وقد علم منه لا محالة أنه ابتداء زمن الصوم ، إذ ليس في زمان رمضان إلاّ صوم وفطر وانتهاء أحدهما مبدأ الآخر فكان قوله : { أتموا الصيام إلى الليل } بياناً لنهاية وقت الصيام ولذلك قال تعالى : { ثم أتموا } ولم يقل ثم صوموا لأنهم صائمون من قبل .و { إلى الليل } غاية اختير لها ( إلى ) للدلالة على تعجيل الفطر عند غروب الشمس لأن إلى لا تمتد معها الغاية بخلاف حتى ، فالمراد هنا مقارنة إتمام الصيام بالليل .واعلم أن ثم في عطف الجمل للتراخي الرتبي وهو اهتمام بتعيين وقت الإفطار ، لأن ذلك كالبشارة لهم ، ولا التفات إلى ما ذهب إليه أبو جعفر الخباز السمرقندي من قدماء الحنفية من الاستدلال بثم في هاته الآية على صحة تأخير النية عن الفجر احتجاجاً لمذهب أبي حنيفة من جواز تأخير النية إلى الصحوة الكبرى .بناء على أن ثم للتراخي وأن إتمام الصيام يستلزم ابتداءه ، فكأنه قال ثم بعد تبيين الخيطين من الفجر صوموا أو أتموا الصيام إلى الليل فينتج معنى صوموا بعد تراخ عن وقت الفجر وهو على ما فيه من التكلف والمصير إلى دلالة الإشارة الخفيفة غفلة عن معنى التراخي في عطف ( ثم ) للجمل .هذا ، وقد رويت قصة في فهم بعض الصحابة لهذه الآية وفي نزولها مفرقة ، فروى البخاري ومسلم عن عدي بن حاتم قال : " لما نزلت { حتى يتبين لكم الخيط الأبيض من الخيط الأسود } عمدت إلى عِقال أسود وإلى عقال أبيض فجعلتهما تحت وسادتي فجعلت أنظر في الليل فلا يستبين لي الأبيض من الأسود فغدوت على رسول الله فذكرتُ له ذلك فقال رسول الله : إن وِسادَك لعَرِيض ، وفي رواية : إنك لعَرِيض القفا ، إنما ذلك سواد الليل وبياض النهار " .ورَوَيا عن سهل بن سعد قال نزلت : { وكلوا واشربوا حتى يتبين لكم الخيط الأبيض من الخيط الأسود } ولم ينزل { من الفجر } فكانَ رجال إذا أرادوا الصوم ربط أحدهم في رجله الخيط الأبيض والخيط الأسود ولم يزل يأْكل حتى تتبين له رؤيتهما فأنزل الله بعدُ { من الفجر } ، فيظهر من حديث سهل بن سعد أن مثل ما عمله عدي بن حاتم قد كان عمله غيره من قبلِه بمدة طويلة ، فإن عَدِياً أَسلَمَ سنة تسع أو سنة عشر ، وصيام رمضان فُرض سنة اثنتين ولا يُعقل أن يبقَى المسلمون سبع أو ثمانيَ سنين في مثل هذا الخطأ ، فمحل حديث سهل بن سعد على أن يكون ما فيه وقع في أول مُدة شرع الصيام ، ومحمل حديث عدي بن حاتم أن عدياً وقع في مثل الخطأ الذي وقع فيه مَن تقدموه ، فإن الذي عند مسلم عن عبد الله بن إدريس عن حصين عن الشعبي عن عدي أنه قال لما نزلت : { حتى يتبين لكم الخيط الأبيض من الخيط الأسود من الفجر } الخ فهو قد ذكر الآية مستكملة ، فيتعين أن يكون محمل حديث سهل بن سعد على أن ذلك قد عمله بعض الناس في الصوم المفروض قبلَ فَرْض رمضان أي صوممِ عاشوراء أو صوممِ النَّذْر وفي صوم التَّطوع ، فلما نزلت آية فرض رمضان وفيها { من الفجر } علموا أن ما كانوا يعملونه خطأ ، ثم حَدث مثل ذلك لعدي بن حاتم .وحديث سهل لا شبهة في صحة سنده إلاّ أنه يحتمل أن يكون قوله فيه ولم ينزل { من الفجر } وقوله فأنزل الله بعد ذلك { مِن الفجر } مروياً بالمعنى فجاء راويه بعبارات قلقة غير واضحة ، لأنه لم يقع في «الصحيحين» إلاّ من رواية سعيد بن أبي مريم عن أبي غسان عن أبي حازم عن سهل بن سعد فقال الراوي : «فأنزل بعد أو بعدَ ذلك من الفجر» وكان الأوضح أن يقول فأنزل الله بعدُ : { وكلوا واشربوا } إلى قوله { من الفجر } .وأيّاً ما كان فليس في هذا شيء من تأخير البيان ، لأن معنى الخيط في الآية ظاهر للعرب ، فالتعبير به من قبيل الظاهر لا من قبيل المجمل ، وعدمُ فهم بعضهم المرادَ منه لا يقدح في ظهور الظاهر ، فالذين اشتبه عليهم معنى الخيط الأبيض والخيط الأسود ، فهموا أَشهر معاني الخيط وظَنوا أن قوله : { من الفجر } متعلق بفعل { يتبين } على أن تكون ( مِنْ ) تعليلية أي يكون تبينه بسبب ضوء الفجر ، فصنعوا ما صنعوا ولذلك قال النبي صلى الله عليه وسلم لعدي بن حاتم «إنّ وسادك لعريض أو إنك لعريض القفا» كناية عن قلة الفِطنة وهي كناية موجهة من جوامع كلمه عليه السلام .وقوله تعالى : { ولا تباشروهن وأنتم عاكفون } عطف على قوله { باشروهن } لقصد أن يكون المعتكف صالحاً . وأجمعوا على أنه لا يكون إلاّ في المسجد لهاته الآية ، واختلفوا في صفة المسجد فقيل لا بد من المسجد الجامع وقيل مطلق مسجد وهو التحْقيق وهو مذهب مالك وأبي حنيفة والشافعي رحمهم الله ، وأحكامه في كتب الفقه وليست من غرض هذا المفسر .تذييل بالتحذير من مخالفة ما شرع إليه من أحكام الصيام . فالإشارة إلى ما تقدم ، والإخبار عنها بالحدود عيَّن أن المشار إليه هو التحديدات المشتمل عليها الكلام السابق وهي قوله : { حتى يتبين لكم الخيط } وقوله : { إلى الليل } { وأنتم عاكفون } من كل ما فيه تحديد يفضي تجاوزه إلى معصية ، فلا يخطر بالبال دخول أحكام الإباحة في الإشارة مثل : { أحل لكم } ومثل { فالئن باشروهن } .والحدود الحواجز ونهايات الأشياء التي إذا تجاوزها المرء دخل في شيء آخر ، وشبهت الأحكام بالحدود لأن تجاوزها يخرج من حل إلى منع وفي الحديث " وحَدَّ حدوداً فلا تعتدوها " وستأتي زيادة بيان له في قوله تعالى : { تلك حدود الله فلا تقربوها } .وقوله : { فلا تقربوها } نهى عن مقاربتها الموقعةِ في الخروج منها على طريق الكناية لأن القرب من الحد يستلزم قصد الخروج غالباً كما قال تعالى : { ولا تقربوا مال اليتيم إلا بالتي هي أحسن } [ الأنعام : 152 ] ، ولهذا قال تعالى في آيات أخرى : { تلك حدود الله فلا تعتدوها } [ البقرة : 229 ] . كما سيأتي هنالك وفي معنى الآية حديث " من حام حول الحمى يوشك أن يقع فيه " .والقول في : { كذلك يبين الله آياته للناس } تقدم نظيره في قوله : { وكذلك جعلناكم أمة وسطاً } [ البقرة : 143 ] أي كما بين الله أحكام الصيام يبين آياته للناس أي جميع رياته لجميع الناس ، والمقصد أن هذا شأن الله في إيضاح أحكامه لئلا يلتبس شيء منها على الناس ، وقوله : { لعلهم يتقون } ، أي إرادةً لاتقائهم الوقوع في المخالفة ، لأنه لو لم يبين لهم الأحكام لما اهتدوا لطريق الامتثال ، أو لعلهم يلتبسون بغاية الامتثال والإتيان بالمأمورات على وجهها فتحصل لهم صفة التقوى الشرعية ، إذ لو لم يبين الله لهم لأتوا بعبادات غير مستكملة لما أراد الله منها؛ وهم وإن كانوا معذورين عند عدم البيان وغير مؤاخذيم بإثم التقصير إلاّ أنهم لا يبلغون صفة التقوى أي كمال مصادفة مراد الله تعالى ، فلعل يتقون على هذا منزل منزلة اللازم لا يقدَّر له مفعول مثل { هل يستوى الذين يعلمون } [ الزمر : 9 ] ، وهو على الوجه الأول محذوف المفعول للقرينة .
Permitted to you upon the night of the Fast is to go in to your wives in sexual intercourse this was revealed as an abrogation of its unlawfulness during the earliest phase of Islam as well as an abrogation of the unlawfulness of eating and drinking after the night prayer; they are a vestment for you and you are a vestment for them a metaphor for their embraces or their need for one another; God knows that you have been betraying yourselves by having sexual intercourse on the eve of the fast this happened with ‘Umar b. al-Khattāb and others and they apologised to the Prophet s and so He has turned to you relenting before you even turned in repentance and He has pardoned you. So now when it is permitted to you lie with them in sexual intercourse and seek what God has prescribed for you of sexual intercourse or what it produces of offspring; and eat and drink at any time during the night until the white thread is distinct to you from the black thread at daybreak that is the true moment of daybreak which explains the white thread while the explanation of the black thread namely the night has been left out. The whiteness and the darkness of the dawn twilight are likened to two black and white threads in the way they stretch out; then complete the fast from daybreak to the night that is until it arrives after the setting of the sun; and do not lie with them your women while you cleave to the mosques in devotion to God while you are residing therein with the intention of performing i‘tikāf ‘spiritual retreat’. This was a prohibition pertaining to one who used to leave the mosque whilst in a state of i‘tikāf have sexual intercourse with his wife and then return. Those rulings mentioned are God’s bounds delimited by God for His servants so that they do not overstep them; do not approach them lā taqrabūhā is more intense than lā ta‘taddūhā ‘Do not overstep’ used in verses elsewhere. So just as He makes clear to you what has been mentioned God makes clear His signs to people so that they might fear disobeying His prohibitions.
Explained here in this verse are the remaining injunctions of fasting including the injunction relating to I` tikaf اعتکاف .
Commentary
The opening words of the verse, أُحِلَّ لَكُمْ (uhilla lakum: 'It is made lawful for you' ) tell us that the act made lawful through this verse was unlawful before. According to a narration by the blessed Companion, Bar-a' ibn ` Azib براء بن عازب appearing in Sahib al-Bukhari, in the early days when the fasts of Ramadan were made obligatory, the permission to eat, drink and have marital intimacy with wives was subjected to the condition that one does not sleep after breaking of the fast. So, as the practice was, a post-iftar nap rendered all these conveniences unlawful. Some Companions ran into difficulties due to this restriction. The blessed Companion, Qays ibn Sarma al-Ansari قہس بن سرما انصاری is reported to have reached home after a hard day's labour. The time of iftar was near and there was nothing to eat. His wife said that she would go out and somehow get him something to eat. When she returned she found her husband asleep, obviously because he was so tired from his day-long work. Now, when he got up, eating had become unlawful. He went on to fast for the next day in the same condition with the result that by afternoon, he fainted (ibn Kathir). Similarly, some Companions, may Allah be pleased with them, were embarrassed getting involved in marital relations with their wives after they had taken a post-iftar nap. It was after such happenings that the present verse was revealed in which the first rule was cancelled and permission was given to eat, drink and have marital relations, even if this was after getting up from the post-iftar nap. In fact, the permission was extended much further when the eating of suhur or sehri towards the fag??? ماکھن end of the night, after getting up from the night's sleep, was declared to be a sunnah. This has been clearly stated in Hadith narrations. The present verse outlines this very injunction.
The literal meaning of the Qur'anic word رَفَث (rafath) is, no doubt, general and covers everything a husband suggests, says or does in making his wife consent to his desire, but there is a total agreement of the Muslim Ummah that, at this place, it means sexual intercourse.
It is important to bear in mind that the order or rule which has been abrogated by this verse, that is, the unlawfulness of eating and drinking after having taken a nap, has not appeared in the text of the Holy Qur'an anywhere. The noble Companions acted in accordance with this rule as set by the Holy Prophet ﷺ (as narrated by Ahmad in his Musnad). This rule is abrogated by the verse only after giving it the authenticity of a divine command. In other words, the verse first establishes the rule in force as the divine command and then, it was for the sake of convenience that it was abrogated. From here we find out that some rules provenly set proven by the Sunnah can also be abrogated through the Qur'an. So, in the Islamic law, the decision of the Messenger ﷺ of Allah has the same authority as the injunction of the Holy Qur'an.
Eating Sahri:
The correct time when fasting begins and all eating and drinking turns unlawful has been fixed through a delicate similitude in the verse حَتَّىٰ يَتَبَيَّنَ لَكُمُ الْخَيْطُ الْأَبْيَضُ مِنَ الْخَيْطِ الْأَسْوَدِ ('until the white thread of the dawn becomes distinct from the black thread' ). Here, the darkness of the night has been likened to the black thread and the light of the dawn to the white thread. In order to eliminate the chances of extremism, the qualifier حَتَّىٰ يَتَبَيَّنَ (becomes distinct) was added which means that one should not act like the chronically skeptical to believe all eating and drinking to be unlawful earlier than the break of dawn, nor should one become so heedless as to go on eating and drinking even after having become certain of the light of dawn. In fact, the certainty of the break of dawn is the line of demarcation between eating and drinking and the intended fast. Before one arrives at this certainty, it is not correct to take eating and drinking as haram حرام . Similarly, after the certainty, any indulgence in eating and drinking shall be haram حرام ، and is a source which may lead to the spoiling of the fast, even if it exceeds the limit for a minute. The latitude and leeway allowed in eating suhur remains valid only upto the time one is not certain of the break of dawn. Particular incidents of this nature attributed to some blessed Companions have been reported when they continued eating and drinking well past the break of dawn. This was because they were not yet 'certain' of the dawn and refused to listen to those who favoured to stop much earlier.
In a hadith, the Holy Prophet g is reported to have said: 'The adhan اذان of Bilal ؓ should not stop you from eating suhur because he calls the adhan اذان well ahead in the night. Therefore, you continue eating and drinking, even after having heard Bilal's adhan اذان ، until such time that you hear the adhan اذان called by Ibn Umm Maktum because he calls the adhan اذان precisely at the break of dawn' (Bukhari and Muslim).
Because of the partial reporting of this hadith, some contemporaries misunderstood its provision when they suggested that there is no harm if eating and drinking is continued for a little while even after the adhan اذان of Fajr فجر and consequently, made it permissible for a person, who woke up late while the adhan اذان of Fajr فجر was being called, that he can hasten to eat something. The fact is that the hadith quoted above has very clearly said that it was necessary to stop eating or drinking with the adhan اذان of Ibn Umm Maktum ؓ which was called precisely at the break of dawn. In addition to that, the Holy Qur'an has itself established the deadline which is the 'certainty' of the break of dawn. Giving people the permission to eat and drink even one minute beyond that is a contravention of the textual imperative of the Holy Qur'an. As for the narrations reported from the noble Companions and early elders of the community regarding the subject of convenience in iftar and suhur, these can be explained, keeping the text of the Holy Qur'an in view, by saying that they aim to avoid excessive precautionary self-restriction well before one becomes certain of the break of dawn. Imam Ibn Kathir (رح) has also explained these narrations as based on the factor mentioned above. Otherwise, how could even a common Muslim tolerate an open contravention of the Qur'anic command? One could not even dream of something like this coming from the blessed Companions, specially so, when the Holy Qur'an has right here at the end of this verse, emphasized special precaution in this respect. Notice how فَلَا تَقْرَبُوهَا (so, do not go near them) has been added to تِلْكَ حُدُودُ اللَّـهِ (These are the limits set by Allah) which explains the point made earlier.
Ruling:
All that has been said here is about people who are at a place from where they could see the break of the dawn with their own eyes and thus become 'certain' of it, moreover, if they have the additional advantage of a clear horizon and the personal ability to recognize the initial light of the dawn, then, it is necessary that they should act directly by looking at the horizon. Where the case is other than this, for example, the horizon is not in open view, or it is not clear, or one does not know how to identify the break of dawn, people determine its time by other signs or calculations. Obviously, for them there will be a time when the certain break of dawn would not be that certain. If it remains doubtful, what should people do then? Imam al-Jassas (رح) ، in his Ahkam al-Qur'an, has answered this question by saying that, in a condition such as this, it will be desirable not to go ahead and eat or drink with considered volition, but, should anyone eat or drink something in a state of doubt, well ahead of becoming certain of the break of dawn, he will not be a sinner. However, should it prove later that dawn had set in at that time, keeping a fast as qada' قضاء will become necessary. For instance, if moon is not sighted on the eve of Ramadan Observe the limits of and people do not fast, but the sighting of the new moon on the 29th was proved later on through witnesses, then, in that case, those who did not fast that day under the impression that it was the 30th of Sha` ban did not become sinners thereby, however, the qada' قضاء of that particular fast will become due on them, a position on which there is a unanimous agreement of the community. Similarly, if someone breaks his fast close to sunset on a cloudy day and the sun turns out to be still there on the horizon later on, then such a person, for that matter, will not be a sinner but he has to do the necessary qada' قضاء for the spoiled fast.
The explanation given by Imam al-Jassas (رح) makes it clear that one who wakes up late and the usual calls of adhan اذان were being made, which necessarily makes it certain that dawn has appeared, then if such a person eats anything knowingly, he will not only be a sinner but also be bound to do gads' قضاء . If he eats in a state of doubt, the sin will be committed but qada' قضاء will still be due with the added factor of reprehensibility in a certain degree.
The worship of I` tikaf
Literally, I` tikaf اعتکاف means to stay at some place in seclusion. In the terminology of the Qur'an and Sunnah, I` tikaf is the act of staying in a mosque under particular conditions. The universality of the word فِي الْمَسَاجِدِ ('in mosques' ) proves that I` tikaf اعتکاف can be performed in every masjid (mosque). The juristic condition that I` tikaf اعتکاف can be done only in a masjid where congregational prayers are regularly held and that I` tikaf اعتکاف is not correct in a desolate masjid where congregational prayers are not held, is really a derivation from the very sense of a masjid since Salah with jams ah (prayer in congregation) is the main purpose of making a masjid, otherwise, individual Salah can be offered in a house, a shop, anywhere.
Ruling
That eating, drinking and marital intimacy are all lawful in the night of fasts has been stated earlier in the verse. In the state of I` tikaf اعتکاف ، the permission to eat and drink in the night remains the same as it is for everybody else, but it is different when it comes to intimacy with women which is not permissible in the state of I` tikaf, not even in the night. Therefore, the verse gives the necessary injunction in this connection. The rules of I` tikaf اعتکاف ، such as, doing I'tikdf اعتکاف while fasting and not coming out of the masjid without pressing needs recognized by Islamic law, are partly derived from the very word of I` tikaf اعتکاف and partly from the sayings and acts of the Holy Prophet ﷺ .
Observe the limits of Allah
Towards the end of the verse, by saying تِلْكَ حُدُودُ اللَّـهِ فَلَا تَقْرَبُوهَا ('These are the limits set by Allah, so do not go near them' ), it has been hinted that the forbiddance of eating, drinking and marital intimacy while fasting are the limits set by Allah. One should not even go near them because, if you go near them, you may cross those limits. This is why overindulgence in gargling while fasting is makruh مکروہ (reprehensible) as it holds the danger of water slipping into the throat; also makruh مکروہ is the use of some medicine inside the mouth; again, equally makruh مکروہ is the kissing and hugging of one's wife. Similarly, it is better to stop eating and drinking a couple of minutes ahead of the time allowed for sahri or suhur just as a matter of precaution, and also, delaying the if-tar a couple of minutes. Becoming heedless and ease-prone in these matters is against this command from Allah.
Fasting by its very nature is an act of patience, and patience involves putting up with all kinds of difficulties in order to carry out God’s commandments. This helps man to attain that state of mind which brings him closer to God. Only those find God who surrender themselves totally to Him, only the words of those reach God whose ‘wavelength’ matches that of God. The command to fast is followed by the command, ‘Do not consume one another’s property by unjust means’ (see 2.
188
). This shows the essence of fasting. The real aim of fasting is to create such a feeling of subservience that when God commands us to abstain from anything, we must do so forthwith. The lesson fasting gives us is that even if God wants us to stay away from lawful things, we must show no hesitation in obeying His command. Thus one who abstains from lawful things if God wants him to do so, will have no difficulty in abstaining from unlawful things if God so commands.
