The Prohibition of marrying Mushrik Men and Women
Allah prohibited the believers from marrying Mushrik women who worship idols. Although the meaning is general and includes every Mushrik woman from among the idol worshippers and the People of the Scripture, Allah excluded the People of the Scripture from this ruling. Allah stated:
مِنَ الَّذِينَ أُوتُواْ الْكِتَـبَ مِن قَبْلِكُمْ إِذَآ ءَاتَيْتُمُوهُنَّ أُجُورَهُنَّ مُحْصِنِينَ غَيْرَ مُسَافِحِينَ
((Lawful to you in marriage) are chaste women from those who were given the Scripture (Jews and Christians) before your time when you have given their due dowry, desiring chastity (i.e., taking them in legal wedlock) not committing illegal sexual intercourse.) (5:5)
`Ali bin Abu Talhah said that Ibn `Abbas said about what Allah said:
وَلاَ تَنْكِحُواْ الْمُشْرِكَـتِ حَتَّى يُؤْمِنَّ
(And do not marry Al-Mushrikat (female idolators) till they believe (worship Allah Alone).) "Allah has excluded the women of the People of the Scripture." This is also the explanation of Mujahid, `Ikrimah, Sa`id bin Jubayr, Makhul, Al-Hasan, Ad-Dahhak, Zayd bin Aslam and Ar-Rabi` bin Anas and others. Some scholars said that the Ayah is exclusively talking about idol worshippers and not the People of the Scripture, and this meaning is similar to the first meaning we mentioned. Allah knows best.
Abu Ja`far bin Jarir (At-Tabari) said, after mentioning that there is Ijma` that marrying women from the People of the Scripture is allowed, "`Umar disliked this practice so that the Muslims do not refrain from marrying Muslim women, or for similar reasons." An authentic chain of narrators stated that Shaqiq said: Once Hudhayfah married a Jewish woman and `Umar wrote to him, "Divorce her." He wrote back, "Do you claim that she is not allowed for me so that I divorce her" He said, "No. But, I fear that you might marry the whores from among them." Ibn Jarir related that Zayd bin Wahb said that `Umar bin Khattab said, "The Muslim man marries the Christian woman, but the Christian man does not marry the Muslim woman." This Hadith has a stronger, authentic chain of narrators than the previous Hadith.
Ibn Abu Hatim said that Ibn `Umar disliked marrying the women from the People of the Scripture. He relied on his own explanation for the Ayah:
وَلاَ تَنْكِحُواْ الْمُشْرِكَـتِ حَتَّى يُؤْمِنَّ
(And do not marry Al-Mushrikat (female idolators) till they believe (worship Allah Alone).)
Al-Bukhari also reported that Ibn `Umar said, "I do not know of a bigger Shirk than her saying that Jesus is her Lord!"
Allah said:
وَلأَمَةٌ مُّؤْمِنَةٌ خَيْرٌ مِّن مُّشْرِكَةٍ وَلَوْ أَعْجَبَتْكُمْ
(And indeed a slave woman who believes is better than a (free) Mushrikah (female idolators), even though she pleases you.)
It is recorded in the Two Sahihs that Abu Hurayrah narrated that the Prophet said:
«تُنْـكَحُ الْمَرْأَةُ لِأَرْبَعٍ: لِمَالِهَا وَلِحَسَبِهَا وَلِجَمَالِهَا وَلِدِينِهَا، فَاظْفَرْ بِذَاتِ الدِّينِ، تَرِبَتْ يَدَاك»
(A woman is chosen for marriage for four reasons: her wealth, social status, beauty, and religion. So, marry the religious woman, may your hands be filled with sand (a statement of encouragement).)
Muslim reported this Hadith from Jabir. Muslim also reported that Ibn `Amr said that Allah's Messenger ﷺ said:
«الدُّنْيَا مَتَاعٌ، وَخَيْرُ مَتَاعِ الدُّنْيَا الْمَرْأَةُ الصَّالِحَة»
(The life of this world is but a delight, and the best of the delights of this earthly life is the righteous wife.)
Allah then said:
وَلاَ تُنكِحُواْ الْمُشِرِكِينَ حَتَّى يُؤْمِنُواْ
(And give not (your daughters) in marriage to Al-Mushrikin till they believe (in Allah Alone).) meaning, do not marry Mushrik men to believing women. This statement is similar to Allah's statement:
لاَ هُنَّ حِلٌّ لَّهُمْ وَلاَ هُمْ يَحِلُّونَ لَهُنَّ
(They are not lawful (wives) for them, nor are they lawful (husbands) for them.) (60:10)
Next, Allah said:
وَلَعَبْدٌ مُّؤْمِنٌ خَيْرٌ مِّن مُّشْرِكٍ وَلَوْ أَعْجَبَكُمْ
(. ..and verily, a believing servant is better than a (free) Mushrik (idolator), even though he pleases you.)
This Ayah indicates that a believing man, even an Abyssinian servant, is better than a Mushrik man, even if he was a rich master.
أُوْلَـئِكَ يَدْعُونَ إِلَى النَّارِ
(Those (Al-Mushrikun) invite you to the Fire) meaning, associating and mingling with the disbelievers makes one love this life and prefer it over the Hereafter, leading to the severest repercussions. Allah said:
وَاللَّهُ يَدْعُواْ إِلَى الْجَنَّةِ وَالْمَغْفِرَةِ بِإِذْنِهِ
(...but Allah invites (you) to Paradise and forgiveness by His leave) meaning, by His Law, commandments and prohibitions. Allah said:
وَيُبَيِّنُ آيَـتِهِ لِلنَّاسِ لَعَلَّهُمْ يَتَذَكَّرُونَ
(...and makes His Ayat clear to mankind that they may remember.)
هذا تحريم من الله عز وجل على المؤمنين أن يتزوجوا المشركات من عبدة الأوثان ثم إن كان عمومها مرادا وأنه يدخل فيها كل مشركة من كتابية ووثنية فقد خص من ذلك نساء أهل الكتاب بقوله "والمحصنات من الذين أوتوا الكتاب من قبلكم إذا آتيتموهن أجورهن محصنين غير مسافحين" قال علي بن أبي طلحة عن ابن عباس في قوله "ولا تنكحوا المشركات حتى يؤمن" استثنى الله من ذلك نساء أهل الكتاب وهكذا قال مجاهد وعكرمة وسعيد بن جبير ومكحول والحسن والضحاك وزيد بن أسلم والربيع بن أنس وغيرهم. وقيل: بل المراد بذلك المشركون من عبدة الأوثان ولم يرد أهل الكتاب بالكلية والمعنى قريب من الأول والله أعلم فأما ما رواه ابن جرير: حدثني عبيد بن آدم بن أبي إياس العسقلاني حدثنا أبي حدثني عبدالحميد بن بهرام الفزاري حدثنا شهر بن حوشب قال: سمعت عبدالله بن عباس يقول نهى رسول الله - صلى الله عليه وسلم - عن أصناف النساء إلا ما كان من المؤمنات المهاجرات وحرم كل ذات دين غير الإسلام. قال الله عز وجل "ومن يكفر بالإيمان فقد حبط عمله" وقد نكح طلحة بن عبدالله يهودية ونكح حذيفة بن اليمان نصرانية فغضب عمر بن الخطاب غضبا شديدا حتى هم أن يسطو عليهما فقالا: نحن نطلق يا أمير المؤمنين ولا تغضب فقال: لئن حل طلاقهن لقد حل نكاحهن ولكني أنتزعهن منكم صغرة قمأة ـ فهو حديث غريب جدا وهذا الأثر غريب عن عمر أيضا قال أبو جعفر بن جرير رحمه الله بعد حكايته الإجماع على إباحة تزويج الكتابيات وإنما كره عمر ذلك لئلا يزهد الناس في المسلمات أو لغير ذلك من المعاني كما حدثنا أبو كريب حدثنا ابن إدريس حدثنا الصلت بن بهرام عن شقيق قال: تزوج حذيفة يهودية فكتب إليه عمر: خل سبيلها فكتب إليه أتزعم أنها حرام فأخلي سبيلها؟ فقال: لا أزعم أنها حرام ولكني أخاف أن تعاطوا المؤمنات منهن. وهذا إسناد صحيح وروى الخلال عن محمد بن إسماعيل عن وكيع عن الصلت نحوه. وقال ابن جرير: حدثني موسى بن عبدالرحمن المسروقي حدثنا محمد بن بشر حدثنا سفيان بن سعيد عن يزيد بن أبي زياد عن زيد بن وهب قال: قال عمر بن الخطاب: المسلم يتزوج النصرانية ولا يتزوج النصراني المسلمة. قال: وهذا أصح إسنادا من الأول ثم قال: وقد حدثنا تميم بن المنتصر أخبرنا إسحق الأزرقي عن شريك عن أشعث بن سوار عن الحسن عن جابر بن عبدالله قال: قال رسول الله - صلى الله عليه وسلم - "نتزوج نساء أهل الكتاب ولا يتزوجون نساءنا" ثم قال وهذا الخبر وإن كان في إسناده ما فيه فالقول به لإجماع الجميع من الأمة عليه كذا قال ابن جرير رحمه الله وقد قال ابن أبي حاتم حدثنا محمد بن إسماعيل الأحمسي حدثنا وكيع عن جعفر بن برقان عن ميمون بن مهران عن ابن عمر أنه كره نكاح أهل الكتاب وتأول "ولا تنكحوا المشركات حتى يؤمن" وقال البخاري: وقال ابن عمر لا أعلم شركا أعظم من أن تقول: ربها عيسى وقال أبو بكر الخلال الحنبلي: حدثنا محمد بن هارون حدثنا إسحق بن إبراهيم وأخبرني محمد بن علي حدثنا صالح بن أحمد أنهما سألا أبا عبدالله أحمد بن حنبل عن قول الله "ولا تنكحوا المشركات حتى يؤمن" قال: مشركات العرب الذين يعبدون الأصنام. وقوله "ولأمة مؤمنة خير من مشركة ولو أعجبتكم" قال السدي: نزلت في عبدالله بن رواحة كانت له أمة سوداء فغضب عليها فلطمها ثم فزع فأتى رسول الله - صلى الله عليه وسلم - فأخبره خبرهما فقال له "ما هي؟" قال تصوم وتصلي وتحسن الوضوء وتشهد أن لا إله إلا الله وأنك رسول الله فقال "يا أبا عبدالله هذه مؤمنة" فقال والذي بعثك بالحق لأعتقنها ولأتزوجنها ففعل فطعن عليه ناس من المسلمين وقالوا نكح أمته وكانوا يريدون أن ينكحوا إلى المشركين وينكحوهم رغبة في أحسابهم فأنزل الله "ولأمة مؤمنة خير من مشركة ولو أعجبتكم" ولعبد مؤمن خير من مشرك ولو أعجبكم" وقال عبد بن حميد حدثنا جعفر بن عون حدثنا عبدالرحمن بن زياد الإفريقي عن عبدالله بن يزيد عن عبدالله بن عمر عن النبي - صلى الله عليه وسلم - قال "لا تنكحوا النساء لحسنهن فعسى حسنهن أن يرديهن ولا تنكحوهن على أموالهن فعسى أموالهن أن تطغيهن وانكحوهن على الدين فلأمة سوداء جرداء ذات دين أفضل" والإفريقي ضعيف وقد ثبت في الصحيحين عن أبي هريرة عن النبي - صلى الله عليه وآله وسلم - قال "تنكح المرأة لأربع: لمالها ولحسبها ولجمالها ولدينها فاظفر بذات الدين تربت يداك" ولمسلم عن جابر مثله وله عن ابن عمر أن رسول الله - صلى الله عليه وسلم - قال "الدنيا متاع وخير متاع الدنيا المرأة الصالحة" وقوله "ولا تنكحوا المشركين حتى يؤمنوا" أي لا تزوجوا الرجال المشركين النساء المؤمنات كما قال تعالى "لا هن حل لهم ولا هم يحلون لهن" ثم قال تعالى "ولعبد مؤمن خير من مشرك ولو أعجبكم" أي ولرجل مؤمن ولو كان عبدا حبشيا خير من مشرك وإن كان رئيسا سريا "أولئك يدعون إلى النار" أي معاشرتهم ومخالطتهم تبعث على حب الدنيا واقتنائها وإيثارها على الدار الآخرة وعاقبة ذلك وخيمة "والله يدعو إلى الجنة والمغفرة بإذنه" أي بشرعه وما أمر به وما نهى عنه "ويبين الله آياته للناس لعلهم يتذكرون".
(Wed not idolatresses). This was revealed about Marthad Ibn Abi Marthad Al-Ghanawi who wanted to marry an idolatress woman by the name of 'Inaq. Allah prohibited such marriage, saying: do not marry idolatresses women (till they believe) in Allah; (for lo! A believing bondwoman) marrying a believing slave woman (is better than an idolatress) who is a free woman (though she pleases you) though you may like her comeliness and beauty; (and give not your daughters in marriage to idolaters till they believe) in Allah, (for lo! A believing slave) Allah says: giving your daughters in marriage to a believing slave (is better than an idolater) is better than your daughter marrying an idolater who is free (though he pleases you) though his body and strength may please you. (These invite unto the Fire) they invite to disbelief and to works that lead to hell, (and Allah inviteth unto the Garden) by means of His divine Oneness, (and unto forgiveness) through repentance (by His grace) by His leave, (and He expoundeth thus His revelations) His commands and prohibitions regarding marriage (to mankind that they may remember) so that they may take admonition and refrain from unlawful marriage.
كان المسلمون أيام نزول هذه السورة ما زالوا مختلطين مع المشركين بالمدينة وما هم ببعيد عن أقربائهم من أهل مكة فربما رغب بعضهم في تزوج المشركات أو رغب بعض المشركين في تزوج نساء مسلمات فبين الله الحكم في هذه الأحوال ، وقد أوقع هذا البيان بحكمته في أرشق موقعه وأسعده به وهو موقع تعقيب حكم مخالطة اليتامى ، فإن للمسلمين يومئذٍ أقاربَ وموالي لم يزالوا مشركين ومنهم يتامى فقَدوا آباءهم في يوم بدر وما بعده فلما ذكر الله بيان مخالطة اليتامى ، وكانت المصاهرة من أعظم أحوال المخالطة تطلعت النفوس إلى حكم هاته المصاهرة بالنسبة للمشركات والمشركين ، فعطف حكم ذلك على حكم اليتامى لهاته المناسبة .روى الواحدي وغيره من المفسرين أن سبب نزول هذه الآية أن رسول الله صلى الله عليه وسلم بعث أبا مَرْثَد الغَنَوي ويقال مَرْثدا بن أبي مَرْثد واسمه كنَّاز بن حُصَين وكان حليفاً لبني هاشم فبعثه إلى مكة سراً ليخرج رجلاً من المسلمين فسمعت بقدومه امرأة يقال لها عَنَاق وكانت خليلة له في الجاهلية فأتتْه فقالت : ويحك يا مَرثد ألا تخلو؟ فقال : إن الإسلام حَرَّم ما كان في الجاهلية فقالت : فتزوجني قال : حتى أستأذن رسول الله فأتى النبي صلى الله عليه وسلم فاستأذنه فنهاه عن التزوج بها ، لأنها مشركة فنزلت هذه الآية بسببه .والنكاح في كلام العرب حقيقة في العقد على المرأة ، ولذلك يقولون نكح فلان فلانة ويقولون نكحت فلانة فلاناً فهو حقيقة في العقد ، لأن الكثرة من أمارات الحقيقة وأما استعماله في الوطء فكناية ، وقيل هو حقيقة في الوطء مجاز في العقد . واختاره فقهاء الشافعية وهو قول ضعيف في اللغة ، وقيل حقيقة فيهما فهو مشترك وهو أضعف . قالوا ولم يرد في القرآن إلاّ بمعنى العقد فقيل إلاّ في قوله تعالى : { فإن طلقها فلا تحل له من بعد حتى تنكح زوجاً غيره } [ البقرة : 230 ] ، لأنه لا يكفي العقد في تحليل المبتوتة حتى يبني بها زوجها كما في حديث زوجة رفاعة ولكن الأصوبُ أن تلك الآية بمعنى العقد وإنما بينت السنة أنه لا بد مع العقد من الوطء وهذا هو الظاهر ، والمنع في هذه الآية متعلق بالعقد بالاتفاق .والمشرك في لسان الشرع من يدين بتعدد آلهة مع الله سبحانه ، والمراد به في مواضعه من القرآن مشركو العرب الذين عبدوا آلهة أخرى مع الله تعالى ويقابلهم في تقسيم الكفار أهلُ الكتاب وهم الذين آمنوا بالله ورسله وكتبه ولكنهم أنكروا رسالة محمد صلى الله عليه وسلمونص هذه الآية تحريم تزوج المسلم المرأةَ المشركة وتحريم تزويج المسلمة الرجلَ المشركَ فهي صريحة في ذلك ، وأما تزوج المسلم المرأة الكتابية وتزويج المسلمة الرجلَ الكتابي فالآية ساكتة عنه ، لأن لفظ المشرك لقب لا مفهوم له إلاّ إذا جَرى على موصوف كما سنبينه عند قوله تعالى : { خير من مشرك } ، وقد أذن القرآن بجواز تزوج المسلم الكتابية في قوله :{ والمحصنات من الذين أوتوا الكتاب من قبلكم } [ المائدة : 5 ] في سورة العقود فلذلك قال جمهور العلماء بجواز تزوج المسلم الكتابية دون المشركة والمجوسية وعلى هذا الأئمة الأربعة والأوزاعي والثوري ، فبقي تزويج المسلمة من الكتابي لا نص عليه ومنعه جميع المسلمين إما استناداً منهم إلى الاقتصار في مقام بيان التشريع وإما إلى أدلة من السنة ومن القياس وسنشير إليه أو من الإجماع وهو أظهر . وذهبت طوائف من أهل العلم إلى الاستدلال لفقه هذه المسألة بطريقة أخرى فقالوا أهل الكتاب صاروا مشركين لقول اليهود عزير ابن الله ولقول النصارى المسيح ابن الله وأبوة الإله تقتضي ألوهية الابن ، وإلى هذا المعنى جنح عبد الله بن عمر ففي «الموطأ» عنه «لا أعلم شركاً أعظم من أن تقول المرأة ربها عيسى» ولكن هذا مسلك ضعيف جداً ، لأن إدخال أهل الكتاب في معنى المشركين بعيد عن الاصطلاح الشرعي ، ونزلت هذه الآية وأمثالها وهو معلوم فاش ، ولأنه إذا تم في النصارى باطراد فهو لا يتم في اليهود ، لأن الذين قالوا عزير ابن الله إنما هم طائفة قليلة من اليهود وهم أتباع ( فنحاص ) كما حكاه الفخر فإذا كانت هذه الآية تمنع أن يتزوج المسلم امرأة يهودية أو نصرانية وأن يزوج أحد من اليهود والنصارى مسلمة فإن آية سورة العقود خصصت عموم المنع بصريح قوله : { والمحصنات من الذين أوتوا الكتاب من قبلكم } [ المائدة : 5 ] ، وقد علم الله قولهم المسيح ابن الله وقول الآخرين عزير ابن الله فبقي تزويج المسلمة إياهم مشمولاً لعموم آية البقرة ، وهذا مسلك سلكه بعض الشافعية .ومن علماء الإسلام من كره تزوج الكتابية وهو قول مالك في رواية ابن حبيب وهو رواية عن عمر بن الخطاب أنه كتب إلى حذيفة بن اليمان وقد بلغه أنه تزوج يهودية أو نصرانية أن خل سبيلها ، فكتب إليه حذيفة أتزعم أنها حرام؟ فقال عمر : لا ولكني أخاف أن تعاطوا المومسات منهن .وقال شذوذ من العلماء بمنع تزوج المسلم الكتابية ، وزعموا أن آية سورة العقود نسختها آية سورة البقرة ، ونقل ذلك عن ابن عمر وابن عباس وفي رواية ضعيفة عن عمر بن الخطاب أنه فرق بين طلحة بن عبيد الله ويهودية تزوجها وبين حذيفة بن اليمان ونصرانية تزوجها ، فقالا له نُطلِّق يا أمير المؤمنين ولا تَغْضَبْ فقال : لو جاز طلاقكما لجاز نكاحكما ، ولكنْ أفرق بينكما صُغْرَةً وقَماءَةً ، قال ابن عطية وهذا لا يسند جيداً والأثر الآخر عن عمر أسندُ منه ، وقال الطبري هو مخالف لما أجمعت عليه الأمة وقد روي عن عمر بن الخطاب من القول بخلاف ذلك ما هو أصح منه وإنما كره عمر لهما تزوجهما حذراً من أن يقتدي بهما الناس فيزهدوا في المسلمات .و { حتى يؤمن } غاية للنهي فإذا آمنَّ زال النهي ولذلك إذا أسلم المشرك ولم تسلم زوجته تبين منه إلاّ إذا أسلمت عقب إسلامه بدون تأخير .وقوله : { ولأمة مؤمنة خير من مشركة } تنبيه على دناءة المشركات وتحذير من تزوجهن ومن الاغترار بما يكون للمشركة من حسب أو جمال أو مال وهذه طرائق الإعجاب في المرأة المبالغ عليه بقوله : { ولو أعجبكم } وأن من لم يستطع تزوج حرة مؤمنة فليتزوج أمة مؤمنة خير له من أن يتزوج حرة مشركة ، فالأمة هنا هي المملوكة ، والمشركة الحرة بقرينة المقابلة بقوله : { ولأمة مؤمنة } فالكلام وارد مورد التناهي في تفضيل أقل أفراد هذا الصنف على أتم أفراد الصنف الآخر ، فإذا كانت الأمة المؤمنة خيراً من كل مشركة فالحرة المؤمنة خير من المشركة بدلالة فحوى الخطاب التي يقتضيها السياق ، ولظهور أنه لا معنى لتفضيل الأمة المؤمنة على الأمة المشركة فإنه حاصل بدلالة فحوى الخطاب لا يشك فيه المخاطبون المؤمنون ولقوله : { ولو أعجبكم } فإن الإعجاب بالحرائر دون الإماء .والمقصود من التفضيل في قوله : { خير } التفضيل في المنافع الحاصلة من المرأتين؛ فإن في تزوج الأمة المؤمنة منافع دينية وفي الحرة المشركة منافع دنيوية ومعاني الدين خير من أعراض الدنيا المنافية للدين فالمقصود منه بيان حكمة التحريم استئناساً للمسلمين .ووقع في «الكشاف» حمل الأمة على مطلق المرأة ، لأن الناس كلهم إماء الله وعبيده وأصله منقول عن القاضي أبي الحسن الجرجاني كما في القرطبي وهذا باطل من جهة المعنى ومن جهة اللفظ ، أما المعنى فلأنه يصير تكراراً مع قوله : { ولا تنكحوا المشركات } إذ قد علم الناس أن المشركة دون المؤمنة ، ويُفيت المقصود من التنبيه على شرففِ أقلِّ أَفرادِ أحد الصنفين على أشرَف أفراد الصنف الآخر ، وأما من جهة اللفظ فلأنه لم يرد في كلام العرب إطلاق الأمة على مطلق المرأة ، ولا إطلاق العبد على الرجل إلاّ مقيَّدين بالإضافة إلى اسم الجلالة في قولهم يا عبدَ الله ويا أمةَ الله ، وكونُ الناس إماءَ الله وعبيدَه إنما هو نظر للحقائق لا للاستعمال ، فكيف يخرَّج القرآن عليه .وضمير { ولو أعجبتكم } يعود إلى المشركة ، و ( لو ) وصلية للتنبيه على أقصى الأحوال التي هي مظنة تفضيل المشركة ، فالأمة المؤمنة أفضل منها حتى في تلك الحالة وقد مضى القول في موقع لو الوصلية والواو التي قبلها والجملة التي بعدها عند قوله تعالى : { أولو كان آباؤهم لا يعقلون شيئاً ولا يهتدون } [ البقرة : 170 ] .وقوله : { ولا تنكحوا المشركين حتى يؤمنوا } تحريم لتزويج المسلمة من المشرك ، فإن كان المشرك محمولاً على ظاهره في لسان الشرع فالآية لم تتعرض لحكم تزويج المسلمة من الكافر الكتابي فيكون دليل تحريم ذلك الإجماعَ وهو إما مستند إلى دليل تلقاه الصحابة من النبي صلى الله عليه وسلم وتواتر بينهم ، وإما مستند إلى تضافر الأدلة الشرعية كقوله تعالى :{ فلا ترجعوهن إلى الكفار لا هن حل لهم ولا هم يحلون لهن } [ الممتحنة : 10 ] فعلق النهي بالكفر وهو أعم من الشرك وإن كان المراد حينئذٍ المشركين ، وكقوله تعالى هنا : { أولئك يدعون إلى النار } كما سنبينه .وقوله : { حتى يؤمنوا } غاية للنهي ، وأخذ منه أن الكافر إذا أسلمت زوجته يفسخ النكاح بينهما ثم إذا أسلم هو كان أحق بها ما دامت في العدة .وقوله : { ولعبد مؤمن خير من مشرك ولو أعجبكم } هو كقوله : { ولأمة مؤمنة خير من مشركة } وأن المراد به المملوك وليس المراد الحر المشرك وقد تقدم ذلك .وقوله : { أولئك يدعون إلى النار } الإشارة إلى المشركات والمشركين ، إذ لا وجه لتخصيصه بالمشركين خاصة لصلوحيته للعود إلى الجميع ، والواو في { يدعون } واو جماعة الرجال ووزنه يفعون ، وغُلِّب فيه المذكر على المؤنث كما هو الشائع ، والجملة مستأنفة استئنافاً بيانياً لتعليل النهي عن نكاح المشركات وإنكاح المشركين ، ومعنى الدعاء إلى النار الدعاء إلى أسبابها فإسناد الدعاء إليهم حقيقة عقلية ، ولفظ النار مجاز مرسل أطلق على أسباب الدخول إلى النار فإن ما هم عليه يجر إلى النار من غير علم ، ولما كانت رابطة النكاح رابطة اتصال ومعاشرة نهي عن وقوعها مع من يدعون إلى النار خشية أن تؤثر تلك الدعوة في النفس ، فإن بين الزوجين مودة وإلفاً يبعثان على إرضاء أحدهما الآخر ولما كانت هذه الدعوة من المشركين شديدة لأنهم لا يوحدون الله ولا يؤمنون بالرسل ، كان البون بينهم وبين المسلمين في الدين بعيداً جداً لا يجمعهم شيء يتفقون عليه ، فلم يبح الله مخالطتهم بالتزوج من كلا الجانبين . أما أهل الكتاب فيجمع بينهم وبين المسلمين اعتقاد وجود الله وانفراده بالخلق والإيمان بالأنبياء ويفرق بيننا وبين النصارى الاعتقاد ببنوة عيسى والإيمان بمحمد صلى الله عليه وسلم ويفرق بيننا وبين اليهود الإيمان بمحمد صلى الله عليه وسلم وتصديق عيسى ، فأباح الله تعالى للمسلم أن يتزوج الكتابية ولم يبح تزوج المسلمة من الكتابي اعتداداً بقوة تأثير الرجل على امرأته ، فالمسلم يؤمن بأنبياء الكتابية وبصحة دينها قبل النسخ فيوشك أن يكون ذلك جالباً إياها إلى الإسلام ، لأنها أضعف منه جانباً وأما الكافر فهو لا يؤمن بدين المسلمة ولا برسولها فيوشك أن يجرها إلى دينه ، لذلك السبب وهذا كان يجيب به شيخنا الأستاذ سالم أبو حاجب عن وجه إباحة تزوج الكتابية ومنع تزوج الكتابي المسلمة .وقوله : { والله يدعوا إلى الجنة } الآية أي إن الله يدعو بهذا الدين إلى الجنة فلذلك كانت دعوة المشركين مضادة لدعوة الله تعالى ، والمقصود من هذا تفظيع دعوتهم وأنها خلاف دعوة الله ، والدعاء إلى الجنة والمغفرة دعاء لأسبابهما كما تقدم في قوله : { يدعون إلى النار } .والمغفرة هنا مغفرة ما كانوا عليه من الشرك .وقوله : { بإذنه } الإذن فيه إما بمعنى الأمر كما هو الشائع فيكون بإذنه ظرفاً مستقراً حالاً من ( الجنة ) والمغفرة أي حاصلتين بإذنه أي إرادته وتقديره بما بين من طريقهما . ومن المفسرين من حمل الإذن على التيسير والقضاء والباء على أنها ظرف لغو فرأى هذا القيد غير جزيل الفائدة فتأوَّل قوله : { والله يدعوا } بمعنى وأولياء الله يدعون وهم المؤمنون .وجملة { ويبين } معطوفة على { يدعو } يعني يدعو إلى الخير مع بيانه وإيضاحه حتى تتلقاه النفوس بمزيد القبول وتمام البصيرة فهذا كقوله : { كذلك يبين الله لكم الآيات } [ البقرة : 219 ] ففيها معنى التذييل وإن كانت واردة بغير صيغته . ولعل مستعملة في مثله مجاز في الحصول القريب .
O Muslims Do not marry idolatresses disbelievers until they believe; a believing slavegirl is better than an idolatress who may be a free woman; this was revealed as a rebuttal of the idea that it was shameful to marry a slavegirl and that it was better to marry an idolatress free woman; though you may admire her because of her beauty and wealth this provision excludes the womenfolk of the People of the Scripture as indicated by the verse Q. 55 lawful to you are the chaste women among those who were given the Scripture. And do not marry off believing women to idolaters until they believe. A believing slave is better than an idolater though you may admire him for his wealth and good looks. Those the people of idolatry call to the Fire because they invite one to perform deeds that merit this and for this reason one should not marry with them; and God calls through the voice of His prophets to Paradise and pardon that is to the deeds that merit these two by His leave by His will so that His call may be heeded by marrying with His friends; and He makes clear His signs to the people so that they might remember that they might be admonished.
Verse 221 carries an injunction relating to marriage with Mushrikin (those who associate partners with Allah). The commentary which follows explains the injunction in some detail.
Inter-Marriage between Muslims and Kafirs is Prohibited
In the verses under discussion an important ruling has been given. It states that the marriage of Muslim males with Kafir کافر (disbelieving in Islam) females and the marriage of Kafir کافر females with Muslim males is not permissible. The reason is: Kafir کافر males and females become the cause that leads man into the Hell. Marital relations demand mutual love and harmony and without these the real purpose behind such relationship remains unrealized. If such close relations of love and affection are established with Mushrikin مشرکین or disbelievers, the inevitable effect will be that Muslims may emotionally tilt towards Kufr کُفُر and Shirk or, in a lesser degree, the very abhorrence of Kufr کُفُر and Shirk may just not remain there in their hearts. Consequently, they too, may get involved with Kufr کُفُر and Shirk and thereby end up in Hell. Therefore, it was said that these people call everyone to come to Hell while Allah Almighty calls man to Paradise and to His forgiveness and, for this purpose, states His injunctions openly and clearly so that people follow the wise counsel. Let us consider a few points at this stage:
1. If the word, Mushrik مشرک in this verse is taken to mean non-Muslims as a whole it would be necessary to exempt non-Muslim women of the Ahl al-Kitab اھل الکتاب (the people of the Book) from the purview of this injunction, because it is expressly stated in another verse that:
وَالْمُحْصَنَاتُ مِنَ الْمُؤْمِنَاتِ وَالْمُحْصَنَاتُ مِنَ الَّذِينَ أُوتُوا الْكِتَابَ مِن قَبْلِكُمْ
And good women from among those given the Book before you (marriage with whom is lawful for you). (5:5)
But if the word Mushrik is taken to mean specially those non-Muslims who are not from amongst the Ahl al-Kitab اھل الکتاب (People of the Book i.e. the Jews and the Christians), this verse needs no exception, because it covers only those non-Muslims who do not believe in any prophet and scripture.
2. Let us take the second important point. The Qur'an forbids marital relations between Muslims and disbelievers for the reason that such close relations could become the source of involvement in Kufr کُفُر and Shirk شرک . Now this is apparently true of all non-Muslim groups. Why then, the women from amongst the Ahl al-Kitab اھل الکتاب (the Jews and the Christians) have been excluded?
The answer is obvious. The difference the people of the Book have with Islam is relatively lesser and lighter as compared with other non-Muslims. Islamic belief is tri-polar, that is, Tauhid توحید (Oneness of God), Akhirah (Hereafter) and Risalah (Prophethood). Out of these, if we consider the belief in Akhirah آخرت ، even the Jews and Christians from amongst the people of the Book agree with Muslims in accordance with their original faith, wherein, very similarly, it is kufr کُفُر (infidelity) even in their original faith to attribute partners with God. That the Christians, in their love for Sayyidna ` Isa (علیہ السلام) ، and in their over-enthusiasm towards respecting him, entered the borders of Shirk شرک ، is a different matter.
Now the basic difference that remains is that they do not believe in Muhammad ﷺ as His Messenger . In Islam, this belief is cardinal. Without it, no one can become a true Muslim. However, the fact remains that the difference the people of the Book have is lesser and lighter as compared with other non-Muslim groups. Therefore, the danger of corruptibility is not that great here۔
3. A question may be raised here that the difference between the people of the Book having been declared lighter, it was made permissible for Muslim men to marry their women. So the converse of this proposition, that is, the marriage of Muslim women with non-Muslim people of the Book, should also be permissible. But a little reflection will be sufficient to establish the basic difference between the two situations. Women are somewhat weaker by nature. Then the husband has been given a controlling and care-taking role. So the likelihood of a woman being impressed by his beliefs and views is not that remote. Therefore, should a Muslim woman stay in a marriage relationship with a non-Muslim Kitabi, (Christian or Jew) the chances of her belief being spoiled are strong.
Contrary to this, should a non-Muslim Kitabi woman (Jew or Christian) live married to a Muslim man, it is unlikely in principle that her ideas will impress the husband. Is someone takes to a converse position in total disregard of the normal principles and falls prey to his wife's instigation, it will be because of his own fault.
4. Let us clarify another doubt which may be raised here. The marital relations may influence both the parties equally. Therefore, if there is an apprehension that a Muslim spouse will be influenced by his or her counterpart in the matter of faith, there is also a counter possibility that the non-Muslim spouse will be influenced by his or her Muslim spouse, whereupon he or she will embrace Islam. Both possibilities being equally open, the marital relations between Muslims and non-Muslims should not have been prohibited.
But the wisdom behind this prohibition is that where the danger of a harm and the hope of a benefit are equally applicable, then the reasonable attitude will be to pay more attention to preventing harm than to seeking benefit. There is a well-known Persian saying: عقلمند تریاق بیقین وزھر بگمانخورد . A wise man does not eat the antidote with certainty and the poison with doubt. On the basis of this principle, the hope of the non-Muslim spouse embracing Islam has been ignored, and the apprehension of a Muslim spouse being impressed by the anti-Islamic faith or behaviour has been effectively taken care of.
5. The fifth point worth considering is that the meaning of the permission to Muslim men to marry Jewish and Christian women under formal Nikah (marriage contract) is simply to state that such Nikah if made, will become valid and the children born out of this wedlock will be ligitimate. But there are statements in ahadith which prove that even this Nikah is not viewed with favour. The Holy Prophet has said that a Muslim should seek to marry a woman who fully observes Islamic faith and conduct -- so that she becomes for him a source of strength in their joint pursuit of their faith, and their progeny may have the opportunity to grow up under their care as practising Muslims. When marriage with a non-practising Muslim woman was not looked at with favour, how would it become favourable in the case of some non-Muslim woman? This is why Sayyidna ` Umar al-Faruq ؓ ، on learning that such marriages are finding alarming currency in Iraq and Syria, stopped these with an executive order which pointed out that such marital relations cause corruption in Muslim families both religiously and politically. (Kitab al-Athar-lil-Imam Muhammad). The effect of such marriages in contemporary times when non-Muslim people of the Book, the Jews and the Christians, have a record of political deception, political marriages, entry into Muslim families with persuasion techniques and spying objectives is too obvious and has been admitted by Christian writers themselves as reported in some details by Major General Akbar in his book, حدیثِ دفاع Hadith-e-Difa`,
Specially in our days, there is another important reason for avoiding marital relations with the People of the Book. If the lives of a majority of contemporary Europeans (and Americans), who are called Jews and Christians, and are registered as such in their census records, were researched it will be discovered that an enormous lot of them have nothing to do with Christianity or Judaism. They are atheistically irreligious. They do not believe in Sayyidna ` Isa (علیہ السلام) or in the Bible. They do not believe in Sayyidna Musa (علیہ السلام) or in the Torah -- not even in God or a Day of Judgment. It is obvious that such people do not come under the purview of the Qur'anic injunction permitting marriage (with the people of the Book). Nikah (marriage) with their women is absolutely haram (unlawful). It is clear that such people do not qualify for the exception given in the Qur'anic verse:
وَالْمُحْصَنَاتُ مِنَ الَّذِينَ أُوتُوا الْكِتَابَ
And good women from among those given the Book before you (marriage with whom is lawful for you).
Therefore, Nikah (marriage) with their women, like those of other non-Muslims, is absolutely haram (unlawful).
Special notes from Bayern al-Qur'an by Maulana Ashraf Thanavi
1. It is not correct to marry women from among the group of people who, on the basis of their name and identity, are considered from among the people of the Book but are not proved to be so after a scrutiny of beliefs. For instance, common people these days take white westerners to be generally Christians although some of their beliefs have turned out to be totally atheistic under critical observation. How can people who do not believe in God, in the prophethood of Jesus Christ and in the Bible as revealed scripture be Christians?
Marrying a woman from such a group of people is not correct. Those who marry women from the West without finding out what is involved therein make a gross mistake.
2. Similarly, it is not correct to give a Muslim woman in marriage to a man who, in his outward status, is supposed to be a Muslim but whose beliefs are identical with those of a non-Muslim. And should such corruption of beliefs occur after having been married, the nikah or the marriage-contract breaks ipso facto. For instance, a large number of Muslims, in ignorance of their religion and under the influence of the so-called ` modern thinking', ruin their beliefs. It is, therefore, obligatory for the guardians of a girl that they should first investigate into the beliefs of the proposer before they accept the proposal.
To illustrate the purpose of the matrimonial bond, the relationship between man and woman may be likened to that of a farmer and his field. This means that it is not just for selfish enjoyment that a couple takes the marriage vow. Just as a farmer’s task of planting his fields is a serious matter, so also is the husband/wife relationship a serious one. Various factors have to be taken into account, certain guidelines followed. The first thing to be taken into consideration when choosing a spouse is belief. The relationship between a husband and wife is an extremely delicate one, balanced precariously within a network of social, domestic and psychological factors. For such a close, intricate relationship to flourish there has to be harmony of belief. A Muslim who marries someone of another faith may have to compromise on his beliefs, in which case it will be his faith that suffers; and if he refuses to do so, it will be his marriage which will flounder. Secondly, a husband and his wife should consort and cohabit according to the pattern of creation. Just as revelation is an expression of God’s will, so is nature, for it follows divine commands to the letter. Natural laws are for us to follow, just as revealed laws are to be obeyed. And one should fear God at all times, always remembering that He knows a person’s inner and outer states, and that eventually one is going to be brought before Him.
